Effective today, Nevada Senate Bill 246 revises the definition of “committee for political action” to include new threshold levels.

Entities in Nevada whose primary purpose is to affect outcomes of elections are now defined as those with more than $1,500 in contributions or expenditures in a calendar year. Entities whose primary purpose is not to affect outcomes of elections have a $5,000 calendar year threshold. Committees must register with the Nevada secretary of state no later than seven days after qualifying under the revised definition.

The changes in the bill were modeled on similar statutes previously enacted by the state of Maine.

The Colorado Secretary of State’s Office is holding a rulemaking hearing regarding the rules governing lobbyist regulation. The hearing will be held on October 4, 2013, from 9:00 a.m. to 12:00 p.m., in the Blue Spruce Conference Room on the second floor of the Secretary of State’s Office. The public is invited to submit comments before and during the hearing, and the hearing is open to the public for discussion regarding the proposed changes.

The proposed changes include consolidation of several rules, and clarifications such as factors determining whether a violation is substantial, and who qualifies as a rulemaking official.

Gov. John Kitzhaber has announced he will call a one-day special legislative session on September 30, 2013. The special session bill package would raise tax revenues to provide $100 million for K-12 education and $40 million for higher education to prevent tuition increases in the 2013-15 biennium.

It is not yet clear whether the legislative caucuses have the votes to pass all the bills in the package.

Kitzhaber has indicated he will sign none of the bills unless all bills pass.

The Ethics Commission has issued an informal memorandum regarding a new training certification requirement for lobbyist registration.

Beginning September 19, 2013, Part C of the registration form will require the lobbyist to certify he or she has completed the required training in the last two-year period or will complete the training prior to being a regulated lobbyist for two years.

The next live training is scheduled for October 21, 2013. Lobbyists can verify their training status and complete the training online by accessing their account at https://lobby.ethics.state.md.us.

Democratic mayoral candidate William Thompson conceded and threw his support behind leading vote-getter and fellow Democrat Bill de Blasio.

However, because Thompson failed to withdraw from the race by the September 13 deadline, the mayoral runoff will continue to appear on the runoff ballot.

The runoff election is set for October 1, 2013.

De Blasio will face Republican Joe Lhota in the November 5 general election.

January 28, 2014 has been set as the date of a special election for the vacant 78th House District seat.

Local committee members from each party will select the nominees in conjunction with the state party.

As a result, there will be no primary election.

Gov. Scott Walker has called a special election to fill a vacancy in the 21st Assembly District.

The election will be held November 19, 2013.

If more than one candidate files for the seat, a primary election will be held October 22, 2013.

Senate President Don Gaetz is calling for random audits of lobbying firm compensation reports. Gaetz says funding was never set aside for audits to be performed in the past, so he has asked the Senate general counsel to determine what powers the Legislature has to provide funding to conduct audits going forward.

House Speaker Will Weatherford has already indicated his support for the proposal.

A new law in Arizona raising the limits of political contributions to candidates took effect today. Individuals and noncertified political committees will now be able to give $2,000 to candidates running for legislative and statewide offices who do not participate in the state’s Citizens Clean Elections Act campaign financing system. Contributions made to candidates running for local office may be made in amounts up to $2,500. Contribution limits by committees certified by the secretary of state have also been increased.

Additionally, the new law removes aggregate contribution limitations for individuals and some political committees.

Meanwhile, a lawsuit challenging the constitutionality of the new law, which was brought by the Arizona Citizens Clean Elections Commission and others from the state, is pending in Maricopa County Superior Court.

Lawmakers adjourned for the year just after midnight on Friday, September 13, 2013.

Hundreds of bills were passed in the last week of the session including a minimum wage increase, changes to the California Environmental Quality Act, and a bill permitting undocumented immigrants to apply for driver’s licenses.

Several members of city council announced the introduction of legislation to reform independent expenditures made in the city. The legislation would close a “loophole” in state campaign finance law allowing limited liability companies to give at the individual aggregate contribution limit of $150,000 instead of the corporate aggregate limit of $5,000. Such a change would only apply to city elections.

The legislation would also require the disclosure of the top donors to independent expenditure communications.

Finally, the legislation would force any independent expenditure communication to inform voters the communication was not subject to the city’s campaign finance laws.

The Legislature convenes its annual veto session on Wednesday, September 11, 2013. Among the vetoed bills eligible for an override vote are House Bill 110 and Senate Bill 29.

House Bill 110 requires a special election to fill the lieutenant governor’s office if there is an early vacancy due to resignation, death, or impeachment. Senate Bill 29 requires certain public labor unions to obtain annual consent from members before withholding dues and fees from their paychecks for political contributions or expenditures.

Gov. Jay Nixon has declined to call a special session to allow lawmakers to craft a new version of a vetoed income-tax bill. Override votes require a two-thirds vote in each chamber.

Gov. Nathan Deal has issued writs of election to fill vacancies in House Districts 100, 104, 127, and Senate District 14.

The special elections will be held on November 5, 2013. House Districts 100, 104, and Senate District 14 became vacant due to resignations.

House District 127 became vacant due to the passing of Representative Quincy Murphy.

On September 9, 2013, the Oklahoma Legislature adjourned its special session sine die.

Gov. Mary Fallin had called the special session to address the issue of how lawsuits are filed, which became a problem after the Oklahoma Supreme Court invalidated a law on that topic. The special session, which began on September 3, produced 23 bills related to lawsuit reform.

In her press release, Fallin stated, “These measures will help to keep jobs in Oklahoma and further our reputation as a business friendly state.”
