Gov. Jim Justice signed Senate Bill 622 on March 27, with an effective date of June 7.

The bill increases campaign contribution limits allowing $2,800 to candidates, $5,000 to political action committees (PACs), and $10,000 to party committees. The current limits for each category are set at $1,000.

PACs will also be required to electronically file all independent expenditure reports and financial statements.

The bill also requires federal PACs who spend money on state elections to file disclosures with the Office of Secretary of the State.

Kentucky Governor Matt Bevin signed Senate Bill 6 on March 25.

The bill requires executive agency lobbyists to disclose compensation and prohibits compensation contingent on awarding of a government contract or based on a percentage of a government contract awarded.

Senate Bill 6 also extends the length of time a public servant must wait to have certain government contracts from six months to one year.

The bill becomes effective 90 days after the General Assembly is scheduled to adjourn sine die on March 30.

Senate Bill 1500 has made it Gov. Phil Murphy’s desk after being introduced in early 2018.

The bill requires committees to report contributions in excess of $10,000 and expenditures in excess of $3,000 to the Election Law Enforcement Commission.

Additionally, when the contributor is an individual giving more than $10,000, the committee must disclose the occupation of the individual and the name and mailing address of the individual’s employer.

If signed by the governor, the bill will impact the January 15, 2020, independent expenditure report.

Gov. Ned Lamont announced a special election for May 7, to fill a state representative vacancy in House District 130.

The seat became vacant following the passing of State Rep. Ezequiel Santiago on March 15.

The winner of the special election will serve the remainder of Santiago’s term through 2020.

The Minnesota Legislature recently introduced several ethics-related bills during the 91st legislative session.

Senate File 2041 requires public officials to disclose a lobbyist, principal, or other interested person by whom the individual is compensated in excess of $50 in any month for providing services as an independent contractor or consultant.

Additionally, the bill requires both lobbyists and principals to disclose political contributions. If passed, Senate File 2041 will become effective the day following enactment.

Senate File 2039 seeks to prohibit legislators, constitutional officers, commissioners, deputy commissions, assistant commissioners, or heads of any state department or agency from lobbying for seven years after leaving the aforementioned offices or positions.

House File 2391 seeks to prohibit former legislators and certain legislative employees from lobbying the legislature for two years after leaving legislative office or separation from employment.

Senate File 2035 creates a conflict of interest when a legislator or constitutional officer accepts a contribution of more than $500 from a lobbyist, principal, political committee, or political fund with regard to an action coming before the officer when the contributing individual or association has a greater financial interest of greater consequence to the contributor than the general interest of other residents or taxpayers of the state.

If a conflict arises, the covered official must disclose the conflict.

Arizona Attorney General Mark Brnovich will soon rule on whether cities can impose restrictions on dark money in local campaigns.

Sen. Vince Leach alleged Tempe violated a state law prohibiting local governments from requiring tax-exempt organizations from registering as political committees in 2017 by passing a voter approved ordinance banning dark money contributions.

The law allowing a legislator to demand an attorney general to investigate complaints applies only to ordinances, regulations or other official action adopted or taken by the governing board of a county, city or town.

It is unclear if the authority extends to this voter-approved measure referred to the ballot by Tempe City Council.

Tempe’s dark money ordinance was signed by Gov. Doug Ducey in 2017, as constitutionally required, but he noted it may soon be superseded by state law.

The ordinance in question requires any group spending more than $1,000 during an election cycle to disclose the original source of contributions.

The Office of the Attorney General has 30 days to decide if the complaint has merit.

House Speaker Mike Turzai announced a special election for House District 11 on May 21. The special election will be held on the same day as the state primary.

The seat is vacant after Rep. Brian Ellis resigned on Monday amid allegations of sexually assaulting another state government employee in October 2015.

The winner of the special election will serve the remainder of the term through 2020.

Political candidates in Oklahoma will be able to accept $2,800 per election from individuals the next time they run.

The Federal Election Commission increased the individual contributions limit $100 to account for inflation. It is the first increase in four years.

The limit increase applies to primary, runoff primary, and general election ballots in 2020, as well as candidates in any special election this year.

The New Mexico Legislature adjourned sine die on March 16, 2019.

House Bill 668, relating to the State Ethics Commission Act, was passed by the Legislature on the final day of the session.

The bill creates the new independent ethics commission demanded by voters in the November 2018 election.

The new commission will oversee state public officials and employees and give the commission investigative powers over ethics violations.

The bill is awaiting the governor’s signature. If signed, sections one through eight and 34 of the bill will become effective July 1, 2019.

The remaining sections will become effective on January 1, 2020.

The Kentucky General Assembly unanimously advanced Senate Bill 6 to Gov. Matt Bevin’s desk.

The bill requires the disclosure of executive lobbyist compensation and prohibits compensation for executive agency lobbyists contingent on awarding of a government contract or based on a percentage of a government contract awarded.

If signed, the bill will become effective 90 days after the General Assembly adjourns sine die.

State Sen. Michael Rulli introduced legislation to promote greater transparency in local elections by allowing local candidates to file campaign finance reports electronically.

Senate Bill 107 would remove the paper-only filing requirements for individuals who file with local boards of elections.

The bill would also require the secretary of state to make the information in those electronic statements available online.

If passed, the bill would take effect on the first day of January that occurs at least 180 days after the act is filed with the secretary of state.

An investigation done by the Las Vegas Review-Journal this month found little to no oversight or enforcement of Clark County’s lobbying laws.

In addition to listing their clients when they register, current law requires lobbyists to file disclosure forms within five days of meeting with a county commissioner.

The Review-Journal uncovered hundreds of occasions of noncompliance just in 2018. County staff admitted timeliness of lobbyist filings is not tracked, and penalties for late filing and other cases of noncompliance have never been assessed.

In response to the findings, county commissioners have pledged to start enforcing the lobbying provisions and put processes in place to meet its goal of increasing transparency.

Arkansas Gov. Asa Hutchinson signed several bills into law.

Senate Bill 249 increases the fines for violating ethics laws the Arkansas Ethics Commission may levy at violators from $2,000 to $3,500.

Senate Bill 256 prohibits an elected state official from registering as a lobbyist in any jurisdiction while serving as an elected state official and House Bill 1178 amends various sections of law related to competitive sealed bids.

The bills will become effective 90 days after the legislative session adjourns sine die.

Lt. Gov. John Fetterman announced special elections for Senate Districts 33 and 41 on May 21, the same day as the state primary.

The seats are vacant after Senators White and Alloway retired effective February 28.

Each winner of the special election will serve the remainder of the term through 2020.
