Mayor Rahm Emanuel’s office in Chicago is now offering a Google map on the City of Chicago website that allows citizens to follow the mayor’s travels.

The City Hall in Your Community page has markers on its map showing where the mayor has visited. They give us the date of the visit, a picture of the mayor at the event, a link to the original source of the picture, and a description of the event as well as the mayor’s role. It appears there are over one hundred of those markers on the City Hall in Your Community map.

I think this is a good idea for other cities to imitate. It looks like a powerful tool to demonstrate government responsiveness and accountability.

The Philadelphia Board of Ethics has approved proposed regulations that define lobbying activity and describe how lobbyists must register and report expenditures.

If the regulations are approved by the Law Department, they could become effective in early October. A previous board decision to provide a 30 day grace period would not require lobbyist registration until November.

Additionally, registration could begin only when the board has an online registration system in place.  Shane Creamer, executive director of the board, stated he hoped the online registration system would be ready in November.

New Jersey Governor Chris Christie renewed calls on the Legislature to pass ethics reform. In a press release, the governor stated, “New Jersey’s ethics laws remain a patchwork of ineffective half measures and loopholes that fail to apply a uniform standard of rules of conduct for all levels of government in our state.”

Highlighting a report issued last week by the State Comptroller which emphasized the failure of the state’s pay-to-play laws, the governor reiterated the need for the changes in his proposals, which include imposing a uniform standard for awarding contracts at all levels and branches of government in New Jersey. His proposals would also end ‘wheeling,’ a practice of transferring political donations to circumvent campaign financing laws.

Governor Christie has pushed pay-to-play reform in New Jersey by linking financial Transitional Aid to municipalities with the requirement the municipalities adopt local pay-to-play ordinances.

The Montana Supreme Court on Wednesday will hear the state’s appeal of the 2010 decision in Western Tradition Partnership, Inc. v. State of Montana finding the state’s ban on direct corporate spending for or against political candidates unconstitutional.

Citing the U.S. Supreme Court’s decision in Citizens United v. Federal Election Commission, District Judge Jeffrey Sherlock found the Montana law unconstitutional.

Attorney General Steve Bullock, who has stated the overturned law guaranteed citizens the right to participate in elections without their interests being overshadowed by corporations, will argue the case.

Today the New Jersey State Comptroller A. Matthew Boxer and the Election Law Enforcement Commission (ELEC) Executive Director Jeff Brindle called for a simpler pay-to-play system, tighter contracting rules, and more complete disclosure of contractor contributions.

Comptroller Boxer issued a report finding the state’s pay-to-play laws contain “a series of fatal flaws [that] have essentially rendered New Jersey’s Pay-to-Play law meaningless in the effort to prevent local governments from steering contracts to politically favored vendors.” Director Brindle stated, “Unfortunately, New Jersey’s political history is littered with examples of private contractors securing lucrative public contracts through targeted contributions.”

The comptroller’s report suggests several changes, such as eliminating the fair-and-open exception which has different regulatory systems at the state and local levels, strengthening fair-and-open guidelines to require more competitive contracting, and reforming New Jersey’s contract laws to allow a more competitive vendor-selection process.

Drawing on earlier recommendations from ELEC, Director Brindle also made calls for changes, including for one state pay-to-play law to apply “across the board” for all jurisdictions, emphasizing “the current maze of local and state laws is terribly confusing.” Additionally, ELEC proposes that any public contractor receiving a contract over $17,500 file an annual report with the agency, listing the contractor’s contributions and public contracts. The current disclosure threshold is $50,000. Director Brindle also stated the contribution limits for contractors should be raised to help address fundraising concerns and not discourage participation in the political process.

“Combined with competitive bidding reform as suggested by the Comptroller, together these changes would, I believe, constitute the strongest pay-to-play law in the nation,” Director Brindle said.

North Dakota Governor Jack Dalrymple has called a special legislative session to begin on November 7, 2011.

The session is expected to last five days and will address issues including legislative redistricting and disaster relief.

One measure limits gifts to the mayor and councilors to $50 or less. Another measure creates an ethics board to enforce the newly created gift limits.

The measures were somewhat controversial because many thought the gift restrictions were not strict enough.

The Riverside County Board of Supervisors will be considering a proposal today which would make electronic filing mandatory for all campaign finance reports filed by candidates and PACs.

The county registrar of voters presently has a system that allows for electronic filing; however, use of the system is optional.

The move to mandatory electronic filing is being proposed as a mechanism to increase transparency.

On September 8, 2011 New York City’s Campaign Finance Board proposed new rules requiring the reporting of certain independent expenditures.

The proposed reporting rules would cover expenditures that are for the design, production, or distribution of public communications, that are either express advocacy made at any time in an election cycle or an electioneering communication made within 90 days of an election, and that, when combined with all other expenditures made by the independent spender in support of or in opposition to that candidate or proposal, exceed $1,000.

Generally, in non-election years reports would be due semi-annually and in election years eight reports would be required, with expenditures required to be reported within 24 hours during the two weeks before the election.

On this day in history 161 years ago, September 7, 1850, California was admitted to enter into the Union as a free state as part of the Compromise of 1850.

Two days after the House passed the bill, President Millard Filmore signed the measure into law, allowing California to enter the union as the 31st state on September 9th.

A pay-to-play ordinance has been introduced in Montclair, New Jersey.

The ordinance would prohibit business entities which have made local political contributions from contracting with the township if the contributions were made within one year immediately preceding the date of the contract or agreement and are in excess of certain thresholds. Contribution thresholds include a maximum of $300 per calendar year each for any purpose to any candidate or candidate committee for mayor or governing body, $500 per calendar year to any joint candidates committee for mayor or governing body, and $500 maximum per calendar year to any PAC. Penalties for violating the ordinance include a four ban on contracting with the township.

A business entity may cure a violation of the ordinance, if, within 30 days after the date on which the applicable ELEC report is published, the business entity notifies the municipality in writing and seeks and receives reimbursement of the contribution from the recipient of such contribution.

Public comments will be accepted at the next Township Council meeting on September 20.

The Nebraska Accountability and Disclosure Commission has voted to approve the creation of the proposed First Spouse’s Fund to benefit the spouse of the state’s governor.

The Commission voted 7-1 to approve an advisory opinion concerning the legality of collecting private donations to cover expenses of the governor’s spouse.

The fund is designed to reimburse the spouse of the governor for expenses incurred as a result of his or her position as first spouse, while also ensuring there is no conflict with Nebraska gift and contribution laws.

The Kentucky Legislative Ethics Commission has issued recommendations to reform the state code of ethics.

The Commission has recommended repealing the provision allowing lobbyists to spend $100 annually on food and beverages for each legislative official and their respective families.

Further, the Commission has recommended that candidates for the state legislature be subjected to the same gift restrictions as legislative officials.

This would include a prohibition on the receipt of anything of value from lobbyists.

Governor Dannel P. Malloy is set to name David L. Guay as the head of Connecticut’s newly created Office of Governmental Accountability.

Guay was one of three finalists for the position of executive administrator recommended to the governor in July by the heads of the nine agencies comprising the new Office of Governmental Accountability, including the Office of State Ethics and the State Elections Enforcement Commission.

Guay has served as the executive director of the Board of Accountancy since 1989, and has also held the position of director of election campaign finance services.

Guay’s new position calls for assisting each of the nine agencies in meeting their needs, while also promoting autonomy over the watchdog function each agency provides.
