Michigan Governor Rick Snyder announced the dates for a special election Wednesday, and Genesee County Clerk John Gleason is pleased with his choice. The special election for the 49th District House seat will take place on Election Day, November 5, with the primary, if needed, to be conducted on August 6.

Gleason had said he was hoping Snyder would save the county money and schedule the special election on the normal election days, but he was not sure it would actually happen. “I’m tickled about that. I’m so glad. [He] never contacted us, but it worked out all right. The most important thing is that they got it right. It’s good for the taxpayers.”

Gleason started the run of special elections for Genesee County when he left the 27th District Senate seat after winning the November election for county clerk. Jim Ananich won the special election for the vacant Senate seat in May, leaving his House seat open.

Two people have already announced their intentions to run for the seat. Kyle McCree, manager of Community Outreach for the Flint & Genesee Chamber of Commerce, announced earlier this week he plans to run and Phil Phelps, former special advisor for Richard Hammel and former chief of staff for Pam Farris, has been campaigning since April.

The Legislature adjourned late Tuesday, May 14, 2013, after passing a $1.4 billion budget bill.

Other hallmark legislation of the session included decriminalization of small amounts of marijuana, assisted suicide, and driver’s licenses for migrant workers, but the legislature failed to pass a major campaign finance reform bill.

Supporters of campaign finance reform vowed to revisit the issue in January 2014.

A special election for the Massachusetts Sixth Bristol Representative District has been called to fill a vacancy caused by the resignation of Representative David B. Sullivan.

The office of the Secretary of the Commonwealth William Galvin announced the special primary election will be held on August 13. The special general election will follow on September 10.

Sullivan resigned his position two weeks ago to become the executive director of the Fall River Housing Authority, according to The Herald News.

Bergen County, New Jersey County Executive Kathleen A. Donovan has vetoed the Board of Chosen Freeholders’ new pay-to-play ordinance that passed on May 1.

This is the second pay-to-play ordinance vetoed by the county executive in the last eight months. On October 5, 2012, Donovan had vetoed a prior pay-to-play measure passed by the Board.

In her press release, the county executive called the newer legislation “an ill-conceived attempt to weaken what has been described as one of the strongest ordinances banning pay-to-play in the State of New Jersey.” Among the reasons cited by Donovan for the veto of Freeholder Ordinance 13-06 are the increase in contribution limits and the weakening of penalties for those found in violation of the pay-to-play law.

Because the new ordinance initially passed by a 6-1 vote, the veto could be overridden by the Board in a future vote.

A bill requiring lobbyists to disclose work as campaign consultants passed in the Texas Legislature on May 9.

House Bill 1422 requires individuals registering as lobbyists with the state to include the full name and address of each person who compensates or reimburses the registrant, or person acting as an agent for the registrant, for services, including political consulting services, rendered by the registrant from:

• A political contribution;
• Interest received from a political contribution; or
• An asset purchased with a political contribution.

The legislation has been sent to Governor Rick Perry. If not vetoed, the bill will become law with or without his signature.

Governor Mike Pence has signed a bill to change legislative lobbying regulations. Enrolled Act 1222 expands the definition of lobbying to include communications with any employee of the legislative branch and requires lobbyists to file registration statements and activity reports electronically.

The bill also increases the annual lobbyist registration fee from $100 to $200 and makes the lobbyist registration year match the current lobbyist reporting periods. Lobbyist registration statements issued for 2013 will expire November 1, 2013.

Most of the bill’s provisions become effective July 1, 2013.

Governor Jay Inslee has signed a bill into law increasing disclosure in political advertising. Senate Bill 5258 was passed by the Washington State Legislature and delivered to the governor on April 23.

The bill requires a series of political advertisements supporting or opposing ballot measures sponsored by the same political committee, each of which is under $1,000, to include information on the advertisement’s top five contributors once the cumulative value of the advertisements reaches $1,000. Under the current law, information on the top five contributors is only required for individual advertisements in excess of $1,000.

This law will take effect on July 28, 2013, but with the first state elections not due to take place until 2014, we will probably not see how big of an impact this new disclosure requirement will have.

Governor Nathan Deal signed two pieces of ethics legislation aimed at increasing public confidence in state government on May 6, 2013. House Bill 142 restores rulemaking powers to the Georgia Government Transparency and Campaign Finance Commission, clarifies and modifies classification as a lobbyist, and sets a gift limit of $75 per lobbyist gift.

House Bill 143 requires more campaign transparency for local races and allows for public notice of any campaign contributions given to members of the General Assembly leading up to the start of the legislative session. The bills become effective January 1, 2014.

The New York City Campaign Finance Board scored a huge win in the courts Friday. Republican mayoral candidate George McDonald had sued the city in hopes of eliminating the city’s strict contribution limits and attempt to bring them in line with the state’s limits. However, the Manhattan court said the city’s contribution limits are legal and reasonable to keep money from influencing elections.

Judge Kathryn Freed, who gave the decision for the court, held, “The court finds that the establishment of uniform limitations on both participating and non-participating candidates is reasonably related and calculated to achieve the goals of reducing the influence of ‘wealthy special interests’ over local elections, and increasing public participation and public confidence in those elections, is well within the powers granted to the City to protect the welfare and well being of its citizens.”

McDonald recently announced that he would join the voluntary public financing system and would conform to the current contribution limits, but promised to keep his fight up in court. McDonald still has the option of appealing this decision, but declined to say whether he would. He was disheartened in the entries process, saying “It’s disappointing that it took 147 days to ‘just say no’ in long form.”

McDonald is the underdog in a three-way battle for the Republican nomination with Joe Lhota and John Catsimatidis. The primary election for the mayor’s office, and all other city offices, is September 10.

The Hawaii State Legislature bid aloha Thursday as it adjourned for the year. In total, the Legislature introduced 2,872 bills and passed 293 of them. Those 293 passed bills will now head to Governor Neil Abercrombie’s desk for his signature.

Among the most important bills passed, was a campaign finance bill aimed at increasing transparency in the campaigning process. House Bill 1147 was passed Thursday night and is now headed to Governor Abercrombie’s desk. Under the bill, non-candidate committees only making independent expenditures will be required to list the names of the top three contributors on all advertisements broadcasted, televised, circulated, or published, which includes posting on the Internet. Originally, the bill required the top five contributors to be disclosed, but it was amended to only include the top three.

Still, Hawaii lawmakers were very pleased with the passage of this particular bill. Representative Chris Lee, the author of the bill, said, “All the political ads they see on TV that are sponsored by these loose organizations with no real background – these folks will have to disclose who the funders actually are so that people can actually go to the ballot box informed about what they’re about to vote on.”

Senate President Donna Mercado Kim added, “We should have transparency that people are free to go ahead and have their First Amendment, if it’s by way of donation and contributing, but we should be able to know who’s doing it.”

Governor Abercrombie has 45 days, excluding weekends and holidays, to sign the bill and if he does, the bill will become effective on November 5, 2014.

The Florida Legislature adjourned Friday, May 3, 2013, without passing an expansion of the state’s Medicaid program.

Governor Rick Scott has not indicated whether he will call a special session, or leave the issue unresolved until the next legislative session.

The Legislature adjourned sine die early Saturday, May 4, 2013. During this longest-ever legislative session, Governor Jack Dalrymple signed two campaign finance bills to establish registration and reporting requirements for independent expenditures.

Senate Bill 2255 and Senate Bill 2299 expand definitions and reporting requirements for campaign entities making independent expenditures in North Dakota elections. Federal PACs making independent expenditures in excess of $200 in state races will be required to file a copy of the federal report detailing the expenditures.

The bills become effective August 1, 2013.

The Bergen County New Jersey Board of Chosen Freeholders passed an ordinance yesterday modifying the county’s pay-to-play laws.

NorthJersey.com reports the Board voted 6-1 in favor of changes to the code that include lowering the debarment period for future county contracts from four years to one year. Contractors will also be able to make political contributions up to $5,200 to county political parties.

The ordinance must next go to County Executive Kathleen Donovan. Executive Donovan vetoed prior pay-to-play measures last year. If the ordinance is not vetoed, or if a veto is overridden, it will become effective 20 days after publication.

Freeholder Maura DeNicola cast the single vote against the ordinance, calling it “an incumbent protection program” according to NorthJersey.com.

A precept for a special election for State Representative in Hillsborough County District 14 (Manchester Ward 7) was approved on May 1 by New Hampshire Governor Margaret Hassan and the Executive Council.

The primary election will be held on September 17 followed by a special general election on November 5. If there is only one candidate running from each party, there will be no primary election and the special election will be held on September 17.

Additionally, in the election for State Representative in Sullivan County District 4 (Claremont Ward 2), only one candidate from each party filed to participate in that election. The special election date has been changed from July 23 to June 4, the date previously scheduled for that special election’s primary.
