In a long legal battle, the Oklahoma Ethics Commission lost a battle to receive more funding to carry out its oversight functions.

The Legislature appropriates funds to the Ethics Commission, and it complained to the Supreme Court the legislatures have underfunded it for years in violation of the Constitution.

The court rejected the commission’s complaint 5-4, stating it has money “sufficient to enable it to perform its duties,” which the Constitution says.

The Oklahoma Ethics Commission filed suit in the Oklahoma Supreme Court on Tuesday, asking the court to require the Legislature and Gov. Mary Fallin to increase the agency’s funding.

Lawmakers refused to provide the commission with any money from the state’s general revenue fund, leaving it with insufficient funding to complete its constitutional duties.

Earlier this month, the commission increased registration fees for lobbyists and political committees in an effort to increase revenue. Despite doing so, the fiscal year appropriation remains insufficient by more than $2 million.

Oklahoma Gov. Mary Fallin wants a special legislative session to address a budget shortfall caused by a recent Oklahoma Supreme Court Ruling. The Court struck down a cigarette fee resulting in $215 million in lost revenue.

If the budget is not reappropriated, the ruling will force four state agencies to restructure their budgets due to loss of funds. Money cannot be transferred to the affected agencies without a legislative directive.

Though a special session is likely inevitable, legislative leadership has suggested the governor wait to call a session because there are other revenue-related court cases still pending.

Oklahoma lobbyist registration renewals are due by December 31, 2015. However, the renewal software is not yet available. Lobbyists will not be able to renew registrations until the software is ready. All registered lobbyists and liaisons will receive an email with instructions when the renewal feature is available.

At the time of renewal, each lobbyist will pay a $100 annual registration fee as well as a $100 fee for each lobbyist principal registered for 2016. If the principal is registered with the secretary of state, the Guardian System will identify when a principal has been registered multiple times to ensure only one $100 principal fee is charged regardless of the number of lobbyists who register the principal.

When a lobbyist principal is not registered with the Oklahoma Secretary of State, the system will initially charge a $100 fee for each principal regardless of whether the principal has previously been registered.

The ability to pay online at the time of registration will be provided for convenience. A lobbyist can choose to pay in person at the Ethics Commission office or by mailing in the fee.

Governor Mary Fallin issued an executive order calling for legislators to return to the capitol for a special session to begin September 3, 2013.

The order specifies the special session will deal only with the issue of how lawsuits are filed, which became a problem after the Oklahoma Supreme Court invalidated a law on that topic.
