Representative Philip Johnson has introduced House Bill 3025, which would allow employers of lobbyists to host receptions for standing committees in either chamber of the general assembly.

Tennessee law prohibits lobbyist employers from holding receptions, unless all state legislators are invited.

The current prohibition was part of ethics reforms enacted after the Tennessee waltz scandal.

Governor John Hickenlooper signed the first bill to come out of the 2012 legislative session on Monday, January 30, 2012. The bill, Senate Bill 12-014, moves the date for candidates, committees, and political parties to begin filing biweekly campaign finance disclosure reports from the first Monday in July prior to the primary election to the first Monday in May prior to the primary election. This settles an ongoing dispute between lawmakers and Secretary of State Scott Gessler over filing biweekly reports prior to the state’s June 26, 2012 primary.

Lawmakers neglected to alter the beginning of biweekly reporting dates during the 2011 session when they chose to move the state’s primary date from August to June. In reaction to this, Gessler issued a rule declaring biweekly reporting would not begin until after the primary election so as to avoid requiring biweekly reporting for the 2012 election to begin in July, 2011.

After facing backlash from critics claiming he was trying to reduce transparency and following a vote by a legislative committee not to include the rule in the package of approved rules, Gessler issued a new rule declaring biweekly reports would begin for the June 2012 primary election on January 30, 2012, but future primary elections would require biweekly reporting to begin in July of the off-election year and continue until the last Monday of the biweekly schedule prior to the primary.

Unhappy with this decision by Gessler, lawmakers were able to pass SB 12-014 in time to avoid beginning biweekly reporting on Monday. The first biweekly report will now be due May 7, 2012.

Senator Jeanette K. White has introduced Senate Bill 150, a bill concerning lobbyist registration and reporting. The bill proposes the removal of the ability to register within 48 hours of beginning to lobby and would require all lobbyists to register prior to lobbying, employers to register prior to engaging a lobbyist, and lobbying firms to file their lobbyist listings prior to the lobbyists commencing lobbying activities.

The bill also requires lobbying firms to update their listing of lobbyists before any new lobbyist commences lobbying activities and within 48 hours of a lobbyist’s termination. Finally, the threshold on reportable gifts to legislators would be decreased from $15 to $10.

If passed in present form, the changes would take effect July 1, 2012.

The online filing system, Insight, will be offline today, January 26, from 11:00 a.m. – 12:00 p.m. (EST). Filers who attempt to access the system during this time risk losing data.

A separate notice will be sent by the Alaska Public Offices Commission if the fix takes longer than proposed.

Bruce E. Bailey, an attorney from Westerville, Ohio, has been appointed to the Ohio Ethics Commission. Bailey will be taking the seat held previously by former commission chairman Ben Rose.

Rose had requested Governor John Kasich not reappoint him for another term.Bailey’s term will run through January 1, 2018.

State Senator Doug Stoner has proposed legislation that would remove control of ethics enforcement from the General Assembly by making the state’s ethics commission an independent agency.

Senate Bill 315 would also change the name of the Georgia Government Transparency and Campaign Finance Commission to the Georgia Ethics Commission.

The commission would be appointed by the chief justice of the Supreme Court and the chief judge of the Georgia Court of Appeals. Currently, members are appointed by legislators and the governor.

Lobbyist disclosure statements are now accessible by the public on the San Francisco Ethics Commission website. You can search lobbyists, lobbyist clients, lobbying firms, reported public officials, and lobbying subjects of concern.

This site contains information about lobbying activities for all lobbyist who are registered with the Commission. The Commission requires these lobbyists to submit monthly statements of their lobbying activities including: Activity Expenses, Political Contributions, Contacts of Public Officials, and Payments Promised by Clients.

The Ethics Commission is also offering an API (Application Programming Interface) for programmers to take the raw data from lobbyist reports and create mashups and aggregate reports of their own.

The board of ethics has released new campaign contribution limits adjusted for changes in the cost of living.

The new limits for individual contributions have been raised from $2,600 to $2,900 and for political committees or businesses from $10,600 to $11,500.

When the campaign finance law was passed in 2008, a provision was included to increase the maximum contribution every four years based upon the board’s review of the consumer price index.

The Oklahoma State Ethics Commission has approved a rule which creates an exception to the $100 annual gift limit. The rule allows lobbyists to provide a lunch or dinner for a group of legislators once a year, during the legislative session, at the state capitol, without counting the meal against the annual limit. Lobbyists would be required to report the amount spent.

The rule will go into effect on January 1, 2013 unless the legislature disapproves by the end of the 2012 session.

The Oklahoma State Ethics Commission has approved a series of changes to the campaign finance rules. The changes are intended to provide more disclosure from PACs and super PACs.

The new rules impose additional registration and reporting requirements on PACs that make any independent expenditure or electioneering communications in state level races. The changes require disclosure of the amount, date, a brief description or statement of each expenditure, the name of the candidate and office supported or opposed, and whether the expenditure is made to support or oppose the candidate.

The approved rule changes will now go before the state legislature which has until the end of the session to disapprove. If the legislature does not disapprove, the rule changes will go into effect January 1, 2013.

Governor Jack Markell has announced plans to create an online database which will link registered lobbyists to the specific pieces of legislation they are lobbying for or against.

Governor Susana Martinez has endorsed legislative efforts to impose a two-year ban on lobbying for lawmakers. The forthcoming bill may also include civil or criminal penalties if legislators took lobbying jobs sooner than prescribed. All appointees of Governor Martinez have agreed to two-year bans on becoming lobbyists after leaving the position, but she wants formal legislation to hold state lawmakers to the same standard.

State Senator Dede Feldman has proposed Senate Bill 103, which would bar former legislators from lobbying for a shorter one-year period after leaving office. Currently, New Mexico’s lawmakers can quit their office and immediately begin lobbying, just as former state senator Kent Cravens did in September.

Michigan Senator Tonya Schuitmaker has introduced Senate Bill 896, which would require robocalls in the state to clearly identify their sponsor. The bill will also says if a robocall is not endorsed by a candidate, the automated phone message must state it.

The Ohio Joint Legislative Ethics Committee has released Advisory Opinion 2012-001, which prohibits members and employees of the Ohio General Assembly from using their office or employment status in order to promote a registered lobbyist. In its first advisory opinion to be released since 2009, the Committee pointed to Ohio Revised Code section 102.03(D), which prohibits a public official or employee from using his or her status acquired by such position in order to secure anything of value.

The Committee opined that the use of the member or employee in his or her official capacity as Senator, Representative, or legislative staffer in an advertisement or other promotional item would result in a value to the lobbyist, thus resulting in the prohibition. Additionally, the Committee cautioned against allowing such a promotion in merely a personal capacity in order to avoid the appearance of impropriety despite no specific prohibition existing.

The opinion, which was requested by an Ohio registered lobbyist, was deemed necessary after things such as requests for quotes on websites or letters of recommendation to be sent to potential clients had been made of members and employees of the Ohio General Assembly by registered lobbyists.
