A bill to change lobbying regulations has passed the House and is currently in the Senate Committee on Public Policy.

House Bill 1222 expands the definition of lobbying to include communications with any legislative employee and requires lobbyists to file registration statements and activity reports electronically.

The bill also increases the annual lobbyist registration fee from $100 to $200 and makes the lobbyist registration year match the current lobbyist reporting period.

The bill passed the House 94-0 on February 25, 2013.

This year’s push for ethics reform in several state legislatures could not happen fast enough for some elected officials. Georgia’s Senate and Missouri’s Secretary of State, Jason Kander, decided on day one to take matters into their own hands by adopting new gift rules for their respective offices.

The Georgia Senate imposed a $100 limit on gifts from lobbyists. Senators approved the gift cap on the opening day of the 2013 General Assembly session as part of new rules governing the chamber’s operations for the current two-year term. The new rule does not apply to travel costs or to gifts provided to groups of senators, including committees. The rule does allow lobbyists to give $100 gifts on multiple occasions. Meanwhile, House Speaker David Ralston has unveiled an ethics reform bill aimed at expanding the definition of a lobbyist and restricting lobbyist gifts. House Bill 142 would ban even the smallest expenditure of a lobbyist if for the benefit of a single member of the General Assembly. Lobbyists would still be permitted to spend on committees, caucuses, and expenses to public officers for trips to conferences and meetings.

Missouri Secretary of State Jason Kander, sworn in on January 14, 2013, announced a new ethics policy as part of his “Day 1 Achievements.” The new policy prohibits the staff in his office from accepting gifts from lobbyists. State administrative policy already curtails what state employees may accept from lobbyists, but agencies are free to adopt stricter guidelines. Additionally, Missouri’s House and Senate are both considering bills to curb lobbyist spending. House Bill 139 would prohibit General Assembly members, family, and staff from accepting more than $1,000 per calendar year from lobbyists. Senate Bill 181 would prohibit statewide elected officials, legislators, staff, employees, and family from accepting gifts over $50 from a lobbyist.

Secretary of State Beth Chapman announced Janice McDonald, Director of Elections, will retire at the end of the month.

She has worked in the elections division for more than a decade.

Her replacement will be the current supervisor of voter registration, Ed Packard, who has been with the office for more than 15 years.

The House of Representatives has passed ethics legislation to bar lobbyist gifts to individual lawmakers and enact new rules on lobbyist registration.

House Bill 142 passed 164-4 on Monday, February 26, 2013 and now goes to the Senate.

Critics hope the Senate provides a limit for the gift ban exceptions, which allow for unlimited gifts to groups of legislators such as committees and caucuses.

Ohio has increased its campaign contribution limits. Individuals, political action committees (PACs), and political contributing entities (PCEs) may now contribute up to $12,155.52 to any one statewide, senate, or house campaign committee during a primary or general election period, or to a PAC or PCE during a calendar year. An individual may contribute this same amount to the state candidate fund of a county political party in the individual’s county of residence. The previous limit was $11,543.70.

Additionally, the limit individuals, PACs, and PCEs may contribute per calendar year to any one state candidate fund of a state political party increased to $36,466.56 from $34,631.11, and to any one legislative campaign fund, $18,233.28, up from $17,315.55.

These limits are effective beginning February 25, 2013 until February 24, 2015.

New York City Mayor Michael Bloomberg vetoed a campaign finance bill aimed at decreasing campaign finance disclosure, even though City Council overwhelmingly passed the bill by a 47-1 margin in January. The bill would have allowed labor or other membership organizations, as well as corporations, to send communications to its members, executive and administrative personnel, and stockholders without having to disclose that information to the Campaign Finance Board.

Bloomberg was noncommittal at the time about whether he would veto the bill, even though he was adamantly opposed to its passage. However, now with his decision to veto it, the ball will bounce back into the City Council’s court.

The council has 30 days to override the veto, with a two-thirds majority required, or allow the bill to die. The council had enough votes to override the veto originally, but there has been no word on whether every council member will stick with his or her original vote.

The General Assembly adjourned sine die on February 23, 2013.

A reconvened session is scheduled to begin April 3, 2013.

State lawmakers introduced a bill aimed at keeping former legislators out of the lobbying ranks following the end of their terms. Senate Bill 33 would prohibit legislators from lobbying for two years following the end of their public service.

Representative Dana Wachs, a co-sponsor of the bill, said, “If we don’t start doing something about these issues, I think our republic is somewhat in danger. We’re supposed to represent people, not corporations.”

The state does not currently have a prohibition against lobbying after public service, but it does prevent state public officials from appearing, on behalf of someone else for compensation, before a governmental entity under the former official’s responsibility for one year following employment.

Two ethics reform bills will likely be voted on by the full House on Monday, February 25, 2013. House Bill 142, sponsored by Speaker David Ralston, would ban lobbyist spending on individual lawmakers, return regulatory powers to the state ethics commission, and require activists representing an organization to register as lobbyists.

House Bill 143, also sponsored by Ralston, would require lawmakers to file a report early in the legislative session detailing campaign contributions and expenditures during the five-day period before the Legislature convenes.

Senator Ray Jones has introduced a bill to prohibit lobbying during legislative sessions. Senate Bill 183 prohibits both legislative and executive lobbyists from contacting any member of the General Assembly, directly or indirectly, regarding any issue, bill, or proposal under consideration by the General Assembly during regular or extraordinary sessions.

The bill restricts the definitions of legislative agent and executive branch lobbyist to include only those who either receive compensation for lobbying, or those lobbying on behalf of more than one group, organization, business, or public interest issue entity. If passed, lobbyists violating the prohibition will face a fine of $500 for each violation.

Governor Phil Bryant has set the special election to fill the seat of the late Representative Joe Gardner.

The House District 11 election will be held March 26, 2013.

The candidate qualifying deadline is February 25.

This May El Paso, Texas voters will decide whether to move city elections to November or let them remain in the spring.

The City Council voted on February 14, 2013, to allow the voters to amend the city’s charter and choose the timing of future municipal elections. The council did not make any recommendation as to its preference.

If approved, the first November election would be held in 2018, according to the El Paso Times.

The House Government and Veterans Affairs Committee held hearings on February 14, 2013, regarding the establishment of an ethics commission to investigate alleged acts of wrongdoing by elected officials and lobbyists.

House Bill 1442 would create an ethics commission consisting of nine members. Four members are to be appointed by legislators and the remaining five would be appointed by the governor.

North Dakota is currently one of nine states without an ethics commission.

Lobbying and consulting services could soon be subject to sales tax under Governor John Kasich’s budget proposal. House Bill 59, the governor’s expansive budget bill, proposes to decrease the state sales tax rate, but makes up for lost revenue by increasing the services subject to sales tax. All service transactions would be subject to the tax unless specifically exempted in the bill, including legal and accounting services.

While Governor Kasich predicts lobbyists will attempt to remove the tax on their industry from the budget bill, a Florida Institute of CPAs lobbyist claims it’s not just self-interest–determining who is taxed and who pays can be tricky when lobbying firms hire both accountants and lawyers to assist with projects.

If passed, the sales tax will apply to all non-exempt services rendered on or after September 1, 2013.
