A bill overhauling the state’s campaign finance laws and the composition of its ethics agency is making its way through the New Jersey Legislature.

Senate Bill 2866, the Elections Transparency Act, doubles contribution limits to candidates; allows Gov. Murphy to appoint an entirely new slate of commissioners to the Election Law Enforcement Commission without Senate approval; and requires the reporting of all independent expenditure contributions in excess of $7,500.

The act was introduced last June and passed by the Senate on March 20.

A special election has been scheduled for June 13 to fill a vacant state representative seat in Maine House District 45.

The seat became vacant when Rep. Clinton Collamore resigned last month after being indicted on charges related to violations of the state’s Clean Election Act.

The winner of the special election will serve the remainder of the term set to expire at the end of 2024.

The Ohio office of Secretary of State has published increased contribution limits.

The contribution limits for PACs, PCEs and individuals may contribute to statewide candidates, candidates for General Assembly, county parties, PACs, and PCEs increased from $13,704.41 to $15,499.69 per election; and from $41,113.24 to $46,499.08  per calendar year to state parties; and from $20,556.62 to $23,249.54 per calendar year to legislative campaign funds.

The amount of gifts corporations and labor unions may provide per year to a state political party, county political party, or legislative campaign fund, for certain specified purposes, such as facilities; equipment, and supplies, increased from $11,274.23 to $12,751.16.

The 2023 session for the West Virginia Legislature adjourned sine die on March 12. Before adjourning, lawmakers passed bills modifying grassroots lobbying and independent expenditure reporting.

Senate Bill 508, which addresses grassroots lobbying groups, would raise limits triggering certain reporting requirements.

Currently, a person who contributes more than $500 in the aggregate within any three-month period or $200 in the aggregate within any one-month period to a grassroots lobbying campaign would have to register with the State Ethics Commission and comply with certain reporting obligations.

Under the new bill these thresholds would increase to $5,000 and $1,000.

Senate Bill 516 increases the limit to report contributions that are given toward advocating for or against a candidate when not in coordination with a candidate, their political committee, or a political party committee, from $250 to $1,000.

Both bills now head to the governor for signature.

Bismark, North Dakota City Commissioner Mark Splonskowski is resigning effective March 20, due to conflicts of interest when he assumes the Burleigh County auditor/treasurer position in April.

Sponkowski was elected to the county post in November.

The city commission will vote at the March 14 meeting on whether to have a special election to fill his seat or appoint someone to serve out the remainder of the term.

The Wyoming State Legislature adjourned sine die March 3, after passing 196 bills during the 37-day session.

Among the passed bills, the legislature ratified Senate Bill 40. Senate Bill 40 closed an exemption for federal political action committees (PACs) active in Wyoming elections.

Under the new law, federal PACs must file state campaign finance reports unless they are solely making contributions or expenditures to federal candidates or issues.

Other major bills passed during the quick session include universal tax-relief and an omnibus bill focusing on rehabilitating the state’s water infrastructure.

Gov. Mark Gordon has signed a bill removing an exemption from state campaign finance reporting for federal political action committees (PACs) active in Wyoming elections.

Senate Bill 40 requires federal PACs to report in Wyoming unless they are making contributions or expenditures only to federal candidates or federal issues.

The law takes effect July 1.

Mayoral candidate Paul Vallas loaned $100,100 to his campaign after advancing to the April 4 runoff election against Brandon Johnson.

The two candidates may now receive unlimited contributions because contribution limits do not apply in any city race where the self-funding or independent expenditure threshold of $100,000 is exceeded.

The city’s pay-to-play limits on campaign contributions remain in place.

Companies and people doing business with the city or its sister agencies are limited to contributing $1,500 to any one candidate per year.

A special election has been scheduled for May 16 to fill a vacant state representative seat in House District 108.

The seat became vacant when current state Sen. Lynda Schlegel Culver won the January 31 special election for the Senate District 27 seat.

The winner of the special election will serve the remainder of the term set to expire at the end of 2024.

Mayor Lori Lightfoot will not have a second term and none of the nine candidates in the race for mayor secured over 50% of the vote.

The runoff election between candidates Brandon Johnson and Paul Vallas is scheduled for April 4.

Lightfoot is the first incumbent to lose a reelection bid in 40 years.

City Council passed a city charter amendment requiring individuals and entities making independent expenditures related to municipal ballot questions to file disclosure reports.

Local Law No. 22 of 2023 requires individuals and entities making independent expenditures of $5,000 or more in support or opposition to a municipal ballot proposal or referendum to file independent expenditure disclosure reports.

The new reporting requirement will take effect on January 1, 2024.

A coalition of business groups have filed a lawsuit against the Fair Political Practices Commission, seeking to stop enforcement of new pay-to-play restrictions in Senate Bill 1439.

The new law removed the exception for locally elected officials and extended the restricted period from three to 12 months.

The lawsuit seeks to throw out the new law, claiming the bill is unconstitutional, both in the manner it altered the Political Reform Act and in practice.

Plaintiffs allege Senate Bill 1439 does not further the original purpose of the Political Reform Act, but directly conflicts with the original provisions regulating certain financial conflicts of interest of public officials.

Additionally, the plaintiffs claim the bill is unconstitutional on freedom of speech grounds, stating the bill significantly restricts the making and receiving of campaign contributions to local elected officials throughout the state.

No trial date has been set at this time.

Virginia Senate District 9 will have a vacancy created due to state Sen. Jennifer McClellan’s election to the U.S. House of Representatives.

The Richmond Democrat has indicated she intends to resign on March 7.

Virginia’s 9^th Senate District is composed of Charles City County, portions of Hanover and Henrico counties, and parts of Richmond.

The special election has been set for March 28.

The Colorado Secretary of State’s Office issued a notice of temporary adoption of rules taking immediate effect, implementing contribution limit increases consistent with Constitutional requirements.

The Colorado Constitution requires contribution limits to be adjusted based upon the percentage change over a four-year period in the US Bureau of Labor Statistics Consumer Price Index (CPI) for Denver-Boulder-Greeley.

The Secretary of State’s Office calculates the adjustment for each limit and specifies the limits in promulgated rules.

Candidates for governor, lieutenant governor, secretary of state, attorney general, and state treasurer may now accept $725 per election from individuals and political committees, and $7,825 per election from small donor committees.

Additionally, candidates for state Legislature, state Board of Education, University of Colorado regent, and district attorney may now accept $225 per election from individuals and political committees, and $3,100 per election from small donor committees.

Other increases include contribution limits of $23,600 per calendar year from small donor committees to a political party at the state, county, district, and local levels combined.

The next adjustment will take place in the first quarter of 2027.
