On October 14, 2014, New Jersey will implement State of the Art Requisition Technology (NJSTART), a new eProcurement system designed to simplify the procurement process, drive efficiency, and promote competition. The system’s online business directory will be accessible by all state agencies, suppliers, and local governments. Vendors will be able to create individual profiles, receive email alerts for upcoming procurement opportunities, submit proposals, and access training manuals and reference guides.
NJSTART will replace the 25-year-old mainframe system and will allow vendors to access their profiles in real time at any time of day.
Early enrollment is available for vendors who would like to be properly registered when the new system goes live. Because vendors will only be paid if they are registered in the system, vendors on existing contracts are strongly encouraged to register in the system prior to October.

Eric Jackson, the former city public works director, is considered the favorite candidate. Coming into the race Jackson took the lead in campaign financing, while challenger Paul Perez focused his energy on running a positive campaign. There will also be a June 10 runoff for council candidates in the East Ward.

Trenton Mayor Tony Mack was removed from office February 26 after a jury found him guilty of crimes of dishonesty. Mack is ineligible to hold public office in the future and lost his tax-payer funded pension.
City Council President George Muschal was sworn in as acting mayor just hours after a judge ordered Mack’s removal. Although he is willing to serve out Mack’s term, Muschal made it clear he does not intend to run in the regularly scheduled mayoral election on May 13. He plans to spend the next few months working with the state, including Gov. Chris Christie, to facilitate positive change for the city.
After he took office in 2010, Mack’s administration clouded the city in a haze of corruption, cronyism, high crime rates, and financial mismanagement. Mack was convicted February 7 of six counts of bribery, fraud, and extortion; his sentencing is scheduled for May 14 in federal court.

Essentially reversing the May 2013 bill, Monday’s resolution lowers the allowed contribution from no-bid county contractors from $5,200 to $2,000.
Freeholder John Felice, the only individual to vote against the bill, worries it may result in only wealthy citizens running for office.

The inauguration for New Jersey Governor Chris Christie will be held Tuesday, January 21, 2014. The day will begin with a morning prayer service in Newark followed by a swearing-in ceremony and inaugural address in Trenton. Evening festivities include an inaugural celebration at the Great Hall on Historic Ellis Island.
The Governor selected three charities to benefit from the proceeds raised during his second inauguration. Contribution limits do apply for inaugural fundraising events. No person, candidate, candidate committee, joint candidates committee, political committee or continuing political committee may contribute more than $500 in the aggregate to any gubernatorial inaugural fundraising event or events, notwithstanding any contribution made to any candidate for the gubernatorial election. Any contribution given in excess of the $500 aggregate limit will be returned to the contributor.
Similarly, a corporation, association, or labor organization may also contribute to a gubernatorial fundraising event, provided its contribution – when added to that of any related or affiliated corporation, association, or labor organization – does not exceed $500. Partnerships, LLPs, and LLCs may not make contributions as an entity; any contribution made by check or other written instrument drawn on such an account will be considered a contribution from the individual who signed the check or written instrument.
Tickets to gubernatorial fundraising events may be given to legislators and public officials provided there is no intent to influence the official in any matter related to his or her official duties. Lobbyists may provide gifts of entertainment, food, beverages, or tickets to events as long as the aggregate value of all gifts does not exceed $250 per calendar year.

Trenton’s recently established ethics board passed the city’s first code of ethics last week. The long-awaited code outlines behavioral guidelines for elected officials, city employees, and representatives serving on city boards. Included are provisions regarding conflicts of interest, receipt of gifts, and financial disclosure.
Additionally, the code permits the ethics board to investigate possible ethics violations.
The code will go to the state Department of Community Affairs before it is enacted and added to the code book.

NJ Gov. Vetoes Bill Consolidating Election Dates
October 16 and November 5 remain as election dates
Yesterday, New Jersey Gov. Chris Christie vetoed Assembly Bill 4237, which would have merged the dates of this year’s general and special elections.
Because New Jersey’s statewide elections in November are scheduled only 20 days after the October special election, critics have argued the expense of the two elections is too costly for the state and will diminish voter turnout for both elections. The vetoed bill changed the date of the 2013 general election from November 5 to October 16 and directed the secretary of state to provide appropriate notice to state, county, local officials, and the general public as to the change of date.
Another bill vetoed yesterday, Assembly Bill 4249, would have allowed early in-person voting at designated polling places during the special general election scheduled for October 16, 2013. Under the vetoed bill, votes would have been considered in-person early voting for both the vacant U.S. Senator seat and for all offices and public questions to be voted on at the general election on November 5, 2013.

Bergen County, NJ Board Overrides Executive’s Veto on Pay-to-Play Legislation

On May 15, the Bergen County, New Jersey Board of Chosen Freeholders voted to override County Executive Kathleen A. Donovan’s veto of the new pay-to-play ordinance that passed on May 1.
This is the second pay-to-play ordinance vetoed by the county executive in the last eight months. On October 5, 2012, Donovan had vetoed a prior pay-to-play measure passed by the Board.
Freeholder Ordinance 13-06 changes the code to include lowering the debarment period for future county contracts from four years to one year. Under the new ordinance, contractors will also be able to make political contributions up to $5,200 to county political parties.
According to NorthJersey.com, another vote on the ordinance is required because the public notice for the legislation was not properly published. The board next meets on Wednesday, May 22.

A Second Veto for a Second Pay-to-Play Ordinance in Bergen County, NJ

Bergen County, New Jersey County Executive Kathleen A. Donovan has vetoed the Board of Chosen Freeholders’ new pay-to-play ordinance that passed on May 1.
This is the second pay-to-play ordinance vetoed by the county executive in the last eight months. On October 5, 2012, Donovan had vetoed a prior pay-to-play measure passed by the Board.
In her press release, the county executive called the newer legislation “an ill-conceived attempt to weaken what has been described as one of the strongest ordinances banning pay-to-play in the State of New Jersey.” Among the reasons cited by Donovan for the veto of Freeholder Ordinance 13-06 are the increase in contribution limits and the weakening of penalties for those found in violation of the pay-to-play law.
Because the new ordinance initially passed by a 6-1 vote, the veto could be overridden by the Board in a future vote.

Pay-to-Play Ordinance Passes in Bergen County, NJ

The Bergen County New Jersey Board of Chosen Freeholders passed an ordinance yesterday modifying the county’s pay-to-play laws.
NorthJersey.com reports the Board voted 6-1 in favor of changes to the code that include lowering the debarment period for future county contracts from four years to one year. Contractors will also be able to make political contributions up to $5,200 to county political parties.
The ordinance must next go to County Executive Kathleen Donovan. Executive Donovan vetoed prior pay-to-play measures last year. If the ordinance is not vetoed, or if a veto is overridden, it will become effective 20 days after publication.
Freeholder Maura DeNicola cast the single vote against the ordinance, calling it “an incumbent protection program” according to NorthJersey.com.

NJ ELEC Makes Recommendations in Annual Report
2012 Annual Report
In the 2012 Annual report issued by the New Jersey Election Law Enforcement Commission (ELEC) on April 15, the Commission listed several recommendations and ideas to strengthen the state’s campaign finance and lobbying laws.
ELEC recommends requiring disclosure from super PACs and non-profit groups organized under Section 527 and Section 501(c) of the IRS code, requiring disclosure of lobbying activity by local vendors who are required to report pay-to-play contributions, and expanding the 48-hour notice requirement for continuing PAC expenditures to require the filing of notices for expenditures made in May municipal, runoff, school, and special elections.
Among its other recommendations, ELEC calls for the state to expand the regulation of “wheeling” to include contributions by county political party committees to other county political party committees during the entire year.
In the report, the Commission also lists general ideas to strengthen the laws, including requiring grassroots lobbying materials to list the name and address of the committee paying for the material, increasing penalties for public financing violations, and banning the use of partnership funds for the purpose of making contributions.

NJ ELEC Does Not Invalidate Limits on Contributions for Independent Expenditures
Advisory Opinion 01-2013
On March 21, 2013, the New Jersey Election Law Enforcement Commission (ELEC) issued an advisory opinion deciding it does not have the jurisdiction to declare contribution limits unenforceable or unconstitutional for political committees making only independent expenditures.
Advisory Opinion 01-2013 holds current state registration and reporting requirements and contribution limits apply to political committees making independent expenditures.
Fund for Jobs and Growth, a political organization not registered in the state and intending to make independent expenditures in the state’s 2013 elections, requested the opinion in order to determine whether it needed to register and report with the state and whether the state contributions limits for political committees applied to its fundraising activity. The organization was held to be a political committee requiring registration and reporting.
While holding state contribution limits apply, the opinion notes several other jurisdictions have held contribution limits applied to political committees making independent expenditures are unconstitutional. ELEC did not find “that the Third Circuit Court of Appeals has addressed these issues, nor has the United States Supreme Court issued a specific determination concerning the constitutionality of contribution limits for political committees making only independent expenditures.”

Jersey City Passes Additional Pay-to-Play Measures
Adopted December 19, 2012
On December 19, 2012, the Jersey City, New Jersey City Council adopted a number of new pay-to-play measures while tabling another competing version of changes.
City ordinance 12-158 limits vendors winning no-bid contracts from making political contributions over $200 to committees for local state senate, local state assembly, and school board candidates, and to other entities, associations, and forms of association required to register annually with the New Jersey Election Law Enforcement Commission.
Vendors are also prohibited from participating in voter-registration drives, get-out-the-vote activities, and advertising for municipal candidates.
Once signed by the Mayor, the ordinance takes effect on January 8, 2013. City ordinance 12-157, with alternate pay-to-play measures, was tabled by the city council.
