On May 17, three separate bills regarding lobbyists and political donors were introduced in the General Assembly.

If all three bills pass, political committees would be required to report a contributor’s occupation and employment information (Senate Bill 224), lobbyists would be required to disclose the source and amount of received payments (Senate Bill 225), and lobbyists would be required to pay a registration fee or face certain penalties (House Bill 385).

A group of current and past politicians have announced an initiative to strengthen ethics laws in Miami-Dade County.

The group, named An Accountable Miami-Dade, is leading the charge to place a measure on the November ballot. The measure would strengthen enforcement of existing campaign finance laws, create pay-to-play restrictions on large contractors, create a ban on gifts from lobbyists, and institute a $250 per-election contribution limit to mayoral and commission candidates.

An Accountable Miami-Dade is headed by Monica Russo, president of the SEUI Florida Council, and Bettina Rodriguez, a former mayor of Doral. It also includes several local officeholders and party leaders.

On May 13, attorney David Couch petitioned the Arkansas Supreme Court to issue a preliminary injunction requiring Attorney General Leslie Rutledge to approve the language of his ethics initiative or offer an alternative as any further delay could cause “irreparable” harm to Couch’s attempt to get the constitutional amendment on the ballot.

Couch cannot began collecting the 84,859 signatures due by July 8, until Rutledge approves the language.

If approved by voters, the proposed constitutional amendment would prohibit certain gifts from lobbyists to elected officials and lower campaign contribution limits.

The 98th General Assembly adjourned Friday, May 13.

Although ethics reform was a top priority this session, lawmakers fell short of passing bills creating political contribution limits or prohibiting lobbyist gifts. The Legislature did approve a 6-month waiting period for public officials seeking to become lobbyists as well as prohibit legislators from serving as paid political consultants.

Both houses stand adjourned until Wednesday, May 25. They will convene for a technical session and then adjourn sine die on May 30 pursuant to constitutional mandate.

The California Senate voted to reverse the ban on members raising money from lobbyist employers during budget negotiations.

The ban would have gone into effect upon the Governor’s release of the revised budget, which is set for May 13.

The reversal of this rule comes amid an election year where many members of the Senate are running for reelection.

Missouri Gov. Jay Nixon signed two ethics bills on Friday, May 6.

One bill creates a revolving door provision for lawmakers and statewide elected officials seeking to become lobbyists. They must wait at least six months after their terms end before engaging in lobbying. The second bill requires candidates to dissolve their campaign committees and either refund or donate the remaining funds upon registering as lobbyists.

Both bills are effective August 28, 2016.

The Office of Management and Budget issued revised guidance on August 13, 2014, regarding the prohibition against appointing or re-appointing federal lobbyists to serve on advisory committees, boards, and commissions.

The revised guidance clarifies the ban only applies to federal lobbyists serving in their individual capacity. In this situation, individual capacity refers to individuals appointed to committees to exercise their own individual best judgment on behalf of the government.

Federal lobbyists appointed in a representative capacity, meaning they are appointed for the express purpose of providing a committee with the views of a nongovernmental entity, a recognizable group of persons or nongovernmental entities, or a state or local government, are not subject to the ban.

Howard Marlowe, the president of the American League of Lobbyists was featured on C-SPAN’s Washington Journal program. Marlowe discussed the LDA reforms the group is proposing.

According to C-SPAN’s post, Role of Federal Lobbyists: “Howard Marlowe talked about the role of federal lobbying, and he responded to telephone calls and electronic communications. Topics included legislation that affects the industry, and changes the industry itself is proposing that would alter law that governs those engaged in lobbying Congress and senior officials in the Executive Branch.”

Following a board meeting, American League of Lobbyists President Howard Marlowe announced the group has approved rules that would require more people to register as lobbyists, as well as other transparency measures.

According to the National Journal: “The reforms, more than a year in the making, include lowering the registration thresholds, mandating that lobbyists who work for state and local governments or religious organizations register, and shifting enforcement from the U.S. Attorney’s Office to the Justice Department.

The plan would require a person who spends 10 percent of their time lobbying to register as a lobbyist, down from the current 20 percent threshold. And it lowers the number of paid lobbying contacts a lobbyist can have per quarter before registering from two to one. The proposal also shortens the registration window from 45 days to 20 days and would require all lobbyists to undergo ethics training and attend a refresher course every five years.  The proposal preserves exemptions for citizen lobbyists.”

Howard Marlowe, president of the American League of Lobbyists, recently sent a letter to President Obama asking him to change his tone toward lobbyists and the lobbying profession. The organization is making a connection between the administration’s anti-lobbyist rhetoric and the rising number of unregistered lobbyists.

Whether they are calling themselves consultants or advisers, Marlowe points out that these people are lobbying and their activity thus goes on without any oversight:

“Those who are not registered are protected from discovery by the lack of an effective enforcement mechanism. Our primary concern with incentivizing deregistration is that the public loses knowledge of who these people are lobbying, who is paying for their advocacy work, how much they are being paid, and what issues are they being paid to work on.”
