Ask the Experts – A Question about Gift Laws and Upcoming Conferences

Q. Summer is approaching and I will be attending conferences such as NCSL and ALEC. Can I pay for dinners with legislators and/or State Night events?
A. First and foremost, are you or your company registered to lobby in the state? Most states have more stringent gift laws applicable to lobbyists and lobbyist principals (Texas is the exception to this rule of thumb). The answer will also vary depending upon whether you are paying for a private dinner or sponsoring a State Night event. For example, taking a legislator to dinner, paying for cab fare or other transportation, or giving him a ticket to a ballgame are not considered part of the national conference agenda. Therefore, the normal gift limits will apply.
Many states have gift limit exceptions specifically carved out for expenditures at national conferences to which all members of the legislature are invited. State Night events are considered part of the conference agenda; therefore the gift limit exceptions will apply.
Although a State Night sponsorship may be permissible, it is important to determine if and when the expenditure must be disclosed. The reporting implications for such events range from simple aggregate disclosure to detailed reporting where the name of every legislator attending must be listed.

Providence Lobby Law Pushed Back to July 1
Date Change
RHODE ISLAND: The Providence Lobbying Disclosure Ordinance, which was to take effect May 16, will now take effect July 1. The City Council’s Committee on Finance amended the March 11 ordinance extending the time to begin the implementation of the regulations. The new ordinance requires lobbyist registration, reporting, ID badges, and penalties.

Amended Rules Concerning Lobbyist Regulation Released in Colorado
New Lobbying Rules Clarify Previously Vague Provisions
The office of the Secretary of State has released an amended version of the Rules Concerning Lobbyist Regulation, 8 CCR 1505-8. The newly amended rules now include an expanded definition of the term “bona fide personal emergency” to be used in conjunction with determining whether a professional lobbyist or lobbyist firm will be granted a waiver or reduction of an imposed fine, as well as provisions for the suspension, revocation, or other action concerning a lobbyist’s certificate of registration.
The amended rules also include additional guidance to be used by a professional lobbyist for a not-for-profit organization seeking a waiver of the filing fee for the professional lobbyist registration statement.
Finally, amendments were made concerning electronic filing of registration and disclosure statements, noting any statement presented for manual filing with the Secretary of State will not be accepted, but a computer terminal will now be made available in the main office to allow lobbyists to electronically file.

Ask the Experts – Rules When Accompanying a Registered Lobbyist
Here is your chance to “Ask the Experts” at State and Federal Communications, Inc.
Q: I am a registered lobbyist. Can a company executive and/or expert accompany me to meetings with public officials without needing to register?
A: In most instances, individuals are not “insulated” from registration by engaging in lobbying activities in the presence of a registered lobbyist. California is an example of an exception to this rule. In California, an individual does not engage in direct communication when he meets or speaks with a qualifying official in the company of a registered lobbyist retained by the individual’s employer, or by a bona fide trade association or membership organization of which the individual’s employer is a member.
The answer will to depend on the jurisdiction’s registration thresholds. Often times, executives and experts will not have to register because their involvement will not meet the compensation, time, or expenditure threshold in the given jurisdiction. For example, in Connecticut, the expert would have to receive $2,000 in compensation in a calendar year before having to register. A one-time meeting with public officials would probably not exceed this threshold. Likewise, in Massachusetts, there is a statutory presumption that an individual is not a lobbyist if he spends 25 hours or less and receives less than $2,500 for lobbying efforts during any semi-annual reporting period.
The context and content of the conversation are also important in determining whether registration is required. If the executive and/or expert are merely providing testimony at a public hearing, most often this will not be considered lobbying and he will not be required to register. In some cases, as in Arizona, there are exceptions for individuals providing technical information to public officials.
It is always important to remember the “title” of the person is not relevant in determining whether he or she needs to register as a lobbyist in any given jurisdiction.

Iowa News Update
Governor Terry Branstad signed House File 126 into law on Tuesday.
This law, taking effect on July 1, 2011, requires lobbyist registration and reporting only with the legislative branch.
Lobbyists will indicate on this registration whether they will also engage in lobbying executive officials.
Employer reports will still be due each July 31st.

Lobbying News from Iowa
Lobbyists in the Hawkeye State may soon have a streamlined registration and reporting process.
House File 126 has passed both houses of the Iowa Legislature and now awaits approval from Governor Terry Branstad.
This bill would change the state’s law to require lobbyists to register and report with the legislative branch only; currently there is separate registration and reporting for the legislative and executive branches.
Lobbyists would indicate on the registrations whether they will lobby executive officials in addition to lawmakers. Lobbyists would have a combined annual report due each July 31st and registration would open in December for the following calendar year.

Lobbyist Registration Fees on Rise in Texas?
Bill Containing Potential Lobbyist Registration Fee Increase Moving Through House
House Bill 3653, a bill concerning lobbyist registration fees, was brought before the House Appropriations Committee on Monday, April 18, 2011, as the bill moves closer to a vote before the full House.
The bill would provide for lobbyist registration fees of up to $1,000; however, lobbyist registration fees of up to $200 would be assessed if the lobbyist is employed by a 501(c)(3) or 501(c)(4) organization.
If passed, the bill provides for an effective date of September 1, 2011.

Georgia Ethics Bill Approved by Legislature on Final Day of Session
Georgia Legislators Vote to Patch Ethics Loophole as Session Ends
The Georgia General Assembly adjourned late Thursday, April 14, 2011. Among the measures passed on the final legislative day was Senate Bill 160, requiring lobbyist reporting of expenditures made on behalf or for the benefit of a public employee for the purpose of influencing a public officer. The measure will now be sent to the desk of Governor Nathan Deal for his signature.
Senate Bill 160 was amended earlier in the week to close a loophole in state ethics law made public after Advisory Opinion 2011-03, released by the Georgia Government Transparency and Campaign Finance Commission, concluded state law did not require the reporting of such expenditures.
The final semi-monthly disclosure report for state level lobbyists will be due May 1, 2011. Further, the first monthly disclosure report for state level lobbyists will be due June 5, 2011.

News You Can Use from Rhode Island
ACLU Critiques the New Ordinance
News You Can Use Editor Jim Sedor pointed me in the direction of a news item from Providence, Rhode Island. A new ordinance there requires lobbyists to register with City Hall (including a fee), to get a photo ID, and to file quarterly reports. In response, the ACLU of Rhode Island offered a statement saying the ordinance could chill free speech. The issue may go to court.
The article offers the following quote:
“Despite the good and sincere intentions underlying this proposal, we believe it will deter and chill robust community advocacy,” said ACLU Executive Director Steven Brown. “We understand the City’s interest in promoting transparency in government, but this ordinance is not a proper way to achieve that goal.”

Providence Creates Lobbying Registration Law
Registration and Reporting Required
Providence has passed a new lobbyist registration law. The Lobbyist Disclosure Ordinance requires registration before the first lobbying activity. Online registration will be an available option. Each lobbyist will receive an ID badge with his or her name, photograph, identifying information, and the name of each client being represented.
There is a $150 filing fee for lobbyists employed by entities with budgets over $250,000. Otherwise, the filing fee is $25. Lobbyists and employers will be required to file quarterly reports, and a final report in January detailing all expenses and compensation for the previous calendar year.
Penalties include fines up to $250 a day, up to a maximum of $25,000 per calendar year, and a prohibition of lobbying the city until the following year or until compliance is established. The ordinance takes effect May 16.

Advisory Opinion in Georgia Clarifies Lobbyist Registration Statute
Officers and Employees of Business Entities the Focus of New Georgia Advisory Opinion Concerning Lobbyist Registration
The Georgia Government Transparency and Campaign Finance Commission has released Advisory Opinion No. 2011-1, providing for an interpretation of the lobbyist registration statute in regards to individuals who are officers or employees of a business entity. The Commission has determined these individuals must register as lobbyists if they meet with public officials and express opinions on potential or actual legislation that may impact the business entity.
Stacey Kalberman, Executive Secretary of the Commission, prepared the opinion, noting “the General Assembly drafted a broad provision which can only be interpreted to mean that any individual compensated by another, whether as a consultant or an employee, is acting as a lobbyist if such person attempts to influence legislation by the General Assembly.”
This opinion does not affect employees who may be conducting lobbying activities as an uncompensated volunteer, so long as they do not exceed $250 in expenditures.

Lobbyist Registration Coming to Tallahassee
Lobbyists will soon be required to register due to an ordinance recently passed by the Tallahassee city commissioners.
Effective April 1, 2011, lobbyists will be required to register with the city treasurer-clerk prior to engaging in any lobbying. Lobbyists will be required to pay a fee of $25 for each principal represented. Additionally, each lobbying firm may register in the name of the firm, corporation, or legal entity, provided the registration lists the names of all persons who engage in lobbying for the firm.
Further, each lobbying firm will be required to file a quarterly compensation report during each calendar quarter during any portion of which the lobbyist or lobbying firm was registered to represent a principal. A provision was also included in the ordinance stating the annual period of registration will be the calendar year, ending December 31, and noted the first period of registration will begin on the ordinance’s effective date of April 1, 2011, and all registrations during the 2011 year after such time will end on December 31, 2011.

Nevada Lobbyists Bill Mandates Out-of-Session Reporting
Lobbyist Definition Expanded
A bill requiring lobbyists to report activity even when the Legislature is not in session has been introduced by Senator Sheila Leslie. Currently, a lobbyist need only report activity occurring while the legislative body is actually in session.
Nevada’s Legislature generally meets in the first half of odd-numbered years. Senate Bill 0206‘s additional reporting requirements necessitate lobbyists report all lobbying activities after the end of the third and fourth calendar quarter of each odd-numbered year and each calendar quarter of each even numbered year, whether or not any expenditures were made.
The bill also extends the definition of lobbyist to include one who lobbies where an interim committee holds meetings.
