Lawmakers are back to work attempting to combine state elections and ethics boards after a three-judge panel ruled that the General Assembly overstepped its state constitutional authority when it adopted Senate Bill 4 establishing a bipartisan board to oversee elections and consider ethics complaints and issues.

The House Elections Committee approved changes to Senate Bill 68 to remove the bill’s original content relating to school attendance, replacing it with a reworked proposal to create a Bipartisan State Board of Elections and Ethics Enforcement.

Senate Bill 68 would merge the elections and ethics boards, but the governor would be able to appoint all members from nominations made by North Carolina’s Republican and Democratic parties. The board would be split evenly between the two parties.

Senate Bill 68 is set for a floor vote in the House on April 5.

Councilman Dan Gilman introduced a bill to rewrite the city’s campaign finance ordinance. The bill would bring the city’s contribution limits in line with the federal limits, prohibit the transfer of funds from one PAC to another above the stated limit, and make contribution stacking, where a candidate accepts a contribution for a special election and primary election during the same election cycle, illegal.

The bill also eliminates the “millionaire” exception in current law, whereby contribution limits do not apply if a candidate spends more than $50,000 per election cycle on his or her own campaign.

Gilman is also proposing a newly formed ethics board to replace the current one and a new website to compile information on the activities of government entities.

Gov. Scott Walker announced he wants to dismantle the Government Accountability Board (GAB) and replace the independent board overseeing ethics laws with a new entity. The announcement came just days after a state Supreme Court ruling ended the John Doe investigation into alleged violations by the governor’s campaign during the 2012 recall election.

GAB had approved both the investigation and the recall election to which the alleged violations were related.

GAB Director and General Counsel Kevin Kennedy released a statement in support of the board noting it has been a model for other states on how to handle lobbying, ethics, and election laws.

Trenton’s recently established ethics board passed the city’s first code of ethics last week. The long-awaited code outlines behavioral guidelines for elected officials, city employees, and representatives serving on city boards. Included are provisions regarding conflicts of interest, receipt of gifts, and financial disclosure.

Additionally, the code permits the ethics board to investigate possible ethics violations.

The code will go to the state Department of Community Affairs before it is enacted and added to the code book.

Ginny Looney, the Ethics Officer for the city of Atlanta Ethics Office, has announced she will be leaving the position in order to work as a clerk for the Georgia Supreme Court.

Looney, who was the first appointee to the position in 2003, made the announcement at the most recent Atlanta City Council meeting.

Among her accomplishments during her time holding the position, Looney developed the city’s electronic disclosure system, helped to craft city ethics laws, and established the city’s 24/7 ethics hotline.

Looney’s final day is set to be September 30, 2011.
