The Colorado Legislature will convene for the 2021 regular session on January 13.

However, it is expected to pause soon after until February 16 due to growing COVID-19 concerns in the state.

Lawmakers will convene to address urgent business, including swearing in new members, as quickly as possible before temporarily pausing the session.

The tentative plan is to resume February 16 when leaders hope the peak of the pandemic will have subsided. However, work may resume earlier if there is an emergency that requires immediate attention.

This does not affect lobbyist reporting.

A special election for Iowa Senate District 41 is scheduled for January 26.

Gov. Kim Reynolds called the special election to fill the vacancy left by newly elected Congresswoman Mariannette Miller-Meeks, who stepped down last month.

Following a recount, Miller-Meeks was certified by Iowa as the winner by six votes out of nearly 400,000.

The election result, however, is being contested by her Democratic opponent, Rita Hart.

A spokesman for Speaker Nancy Pelosi said Democrats will provisionally seat Miller-Meeks pending the outcome of the challenge.

The House can later decide Hart won the race and should replace Miller-Meeks.

Hart’s contest argues at least 22 lawfully cast votes, including 18 for her, were wrongly excluded due to a variety of errors.

The Associated Press has not called a winner in this race.

The Illinois Legislature began a final session for the 101st General Assembly on January 8.

The Senate met at the Capitol while the House met at the Bank of Springfield Center.

The separate meeting locations accommodated social distancing due to COVID-19 concerns.

Rep. Patrick Windhorst indicated if ethics reforms were not addressed, he would refile a proposal for the 102nd General Assembly, set to convene January 13.

Illinois House Speaker Michael Madigan announced he is suspending his bid for another term as speaker, but is not withdrawing from the race.

A speaker must be elected before the House of Representatives can begin work.

A bill prohibiting corporate campaign contributions has been introduced in the Virginia House of Delegates.

House Bill 1906 would not only prohibit direct contributions to candidates and committees but also prohibit indirect contributions.

This would include designated contributions or contributions directed through another person or committee.

The proposed bill includes a civil penalty of up to twice the amount of the prohibited contributions.

Del. Derrick Evans has announced his resignation from the West Virginia Legislature.

This comes after being arrested and charged for his part in storming the U.S. Capitol Building.

Evans was set to serve his first term as delegate for West Virginia’s 19^th House District after winning the seat in November.

Gov. Jim Justice is expected to appoint a replacement for Evans in the coming weeks.

The North Dakota Legislature convened January 5 for the 2021 session with improvements to live streaming and remote technology, making remote testimony by the public possible.

Committee meetings and floor sessions will be carried live.

House and Senate floor sessions have been live-streamed, archived, and indexed online.

Anyone wishing to testify remotely must register online.

In-person testimony may be permitted by the committee chair, although committee rooms will have limited seating due to social distancing, and masks are required.

State lawmakers may participate remotely from home if infected, or from office space in the Capitol if desired.

While some lobbyists have indicated they may testify remotely, no lawmakers have indicated an intent to work remotely.

A special election for Massachusetts House of Representatives 19^th Suffolk District is scheduled for March 30, with a primary election to be held on March 2.

The seat became vacant after House Speaker Robert DeLeo resigned December 29, 2020.

Both the Vermont House and Senate are scheduled to begin their 2021 sessions Wednesday, January 6.

Due to the ongoing COVID-19 pandemic, a majority of lawmakers will be attending remotely to swear in new members of both chambers and to elect the speaker of the House and the president pro tem of the Senate.

Gov. Phil Scott will remotely give his inaugural address on Thursday, January 7.

The Oklahoma Ethics Commission voted to adopt the proposed changes to the Constitutional Ethics Rules related to lobbying and campaign finance.

Amendment 2021-01 impacts candidate committees formed for elections held prior to 2015. The changes include establishing a mandatory dissolution date of December 31, 2021; removing the limitation of expenditure of funds for only those purposes listed on the committee’s Statement of Organization; and providing a process for dissolving a candidate committee with debt without filing continuing reports with the Commission.

Amendment 3 to 2021-02 impacts lobbying laws by adding a new category of gifts for books and similar informational materials that do not count against the $500 overall aggregate limit of gifts and requiring this category of gift be reported in the same manner as other gifts are reported.

The commission directed the Executive Director to deliver the changes to the legislature and governor on February 1, 2021, in accordance with Article 29, section 3 of the Oklahoma Constitution.

The amendments will become effective upon adjournment sine die of the regular legislative session on May 28, 2021.

The North Carolina State Board of Elections has announced an increase in the limits on contributions made to candidates.

The limit will increase from $5,400 to $5,600 due to the 2.8% rise in the consumer price index from 2018 to 2020.

This increase is effective from January 1, 2021, through December 31, 2022.

Inauguration festivities for Gov. Roy Cooper and other statewide officials will be held as a limited event on January 9 in Raleigh.

Due to ongoing pandemic concerns, attendance at the inauguration will be limited to family, staff, and media.

However, the event will be televised statewide.

The Inaugural Ball celebration has been postponed to an unspecified date when it can be conducted safely.

The inauguration ceremony for New Hampshire Gov. Chris Sununu previously scheduled for Thursday, January 7 has been canceled due to safety concerns.

A small inauguration ceremony will instead take place the same evening followed by Sununu’s inaugural address at 7 p.m.

Alabama Gov. Kay Ivey announced the special election dates for House District 73 to coincide with the previously announced special election for Senate District 14.

The special primary election will be held on March 30, 2021, with a runoff on April 27, if necessary.

The general election will be held on July 13.

The House District 73 was vacated when Rep. Matt Fridy resigned after being elected to the Alabama Court of Civil Appeals.

Attorney General Wayne Stenehjem issued an opinion confirming the Ethics Commission is constitutionally authorized to create a rule expanding the definitions for “lobby” and “lobbyist” for purposes of the new gift rules.

The opinion was issued in response to a request for clarification from Ethics Commission Chairman Ron Goodman.

The definitions used by the commission in the new gift rules in the Administrative Code adopted in October are broader than those passed by the Legislature in House Bill 1521.

The Ethics Commission expanded the definition of lobby and lobbyist to include attempts to influence any public official, administrative rule, or regulation rather than just the Legislature and legislation.

The new rules are not intended to expand the definition of who should be required to be registered as a lobbyist.
