The Los Angeles City Ethics Commission voted Thursday to raise campaign contribution limits for candidates in the upcoming municipal election. Candidates for city council may accept $700 per donor per election cycle, up from a $500 limit. Candidates for citywide offices including mayor, city attorney, and city controller may accept $1,300, up from $1,000.

The new limits go into effect immediately, giving candidates in the March 2013 election the opportunity to contact donors who have already reached the old contribution maximums.

Critics of the new limits believe the commission is tipping the scales in favor of well-connected incumbents who have historically met the contribution threshold more often than their challengers.

ARKANSAS: The fiscal session of the Arkansas General Assembly adjourned at noon on Friday, March 9, 2012.

OREGON: The Oregon Legislative Assembly has adjourned sine die for the 2012 regular session on March 5.

UTAH: The 2012 general session of the Utah State Legislature adjourned sine die on March 8, ending on its 45th day, the last permitted by the Constitution for annual general sessions. Governor Gary Herbert has until March 28 to sign or veto bills presented to him by the legislature.

WASHINGTON: The 2012 regular session of the Washington State Legislature adjourned sine die on March 8, 2012. Governor Gregoire has called for a special session to begin on March 12, 2012 to address a supplemental budget plan.

WYOMING: The State of Wyoming Legislature adjourned sine die on March 8. Governor Matt Mead has until March 26 to sign or veto legislation that reaches his desk.

Citizens in 53 communities approved a measure on Vermont’s Town Meeting Day, coinciding with Super Tuesday, calling on the United States Congress to begin the process of amending the Constitution in order to clarify that corporations do not share the same rights as natural persons possess.

The push for such a measure is a result of the decision of the United States Supreme Court in the Citizen’s United case.

Bernie Sanders, U.S. Senator from Vermont, introduced such an amendment in December and appreciated support by his constituents for his efforts, noting “Unlike the U.S. Supreme Court, Town Meeting Day voters understood that corporations are not people.”

Legislators have introduced bills to remove limitations on the amount of money they can accept from PACs.  Senate Bill 3645 and companion House Bill 3281, remove the aggregate limitations on PAC donations to candidates.  The bills also remove the reporting requirements for large contributions made within 10 days of an election and remove an existing prohibition on insurance companies making campaign contributions.

Senate Speaker Pro Tempore Bo Watson, who introduced the senate bill, has stated the bill is a logical follow through to Senate Bill 1915 enacted last year that authorized direct corporate contributions to state candidates and treats corporations as if they were PACs for reporting purposes.

The Nebraska Supreme Court is scheduled to hear arguments concerning the state’s “fair fight” campaign finance law on Wednesday, March 7, 2012.

The Nebraska Accountability and Disclosure Commission voted unanimously in August to stop enforcement of the 1992 law aimed at leveling the playing field in state political races following a United States Supreme Court decision concerning the state of Arizona where a similar law was deemed unconstitutional.

Under the law, candidates could qualify for “fair fight” money from the state if they adhered to voluntary spending limits and their opponent had exceeded such limits.

A federal court has pushed back Texas’s primary date from April 3 to May 29.

Additionally, the Texas general primary runoff election has also changed to July 31 from June 5.

A three judge panel from the US District Court for the Western District of Texas San Antonio Division, having entered redistricting plans for the 2012 elections for the US House of Representatives, the Texas House of Representatives and the Texas State Senate, found it necessary to make certain adjustments to the election schedule. The court’s order, issued March 1, stipulates various other changes of filing dates and deadlines for candidates and for voting activities concerning elections of federal, state, county, and local offices held in the state.

The court order also mandates that for the 2012 elections to the Texas House and Senate, a person must be a continuous resident of the district the person seeks to represent from April 9, 2012 until the date of the General Election.

Utah Representative Kraig Powell has introduced a bill prohibiting anonymous cash contributions over $50 and requiring forfeiture of the contributions.

As written in HB 493, anonymous contributions over $50 to state and local candidates must be given to the governmental entity where the position the candidate is pursuing exists, such as to a school district’s general fund for a local school board candidate. Other beneficiaries of the anonymous political donations over $50 would be the state’s general fund, and county and municipality general funds.

Reporting by the candidates of the transferred anonymous contribution would not be required.

The U.S. Supreme Court has rejected a challenge to Maine election laws brought by the National Organization for Marriage claiming Maine’s reporting requirements for political action committees are vague and over-broad.

The Supreme Court let stand the 1st Circuit Court of Appeals’ decision to uphold the constitutionality of the laws requiring the disclosure of contributions and expenditures in elections by PACs and by independent groups.

Maine defended its laws by arguing the laws were designed to inform voters about who is spending money to influence their votes.

The State Ethics Commission has found the county’s new public ethics law to be below state standards because it allows elected leaders to accept tickets to sporting events from people who do business with the county.

Although state lawmakers are prohibited from free sports tickets, both state and county laws allow lawmakers to accept free admission to charitable, cultural, and political affairs events if the tickets come from the events’ sponsors.

Michael Lord, Executive Director of the commission, notes that the county’s ethics law does not call for disclosure of those tickets, which is required under state rules.

The county has maintained that its ethics laws are among the toughest in the state, but the commission has warned the county that it is not in compliance with a 2010 law that requires local ethics laws to be at least as strong as those state lawmakers must follow.

The Texas Ethics Commission announced there is no requirement to file the 30-day pre-election report due March 5th.

Normally, committees such as general and specific-purpose political committees that support or oppose a candidate or measure must file reports 30 days before an election in which the committee is involved, covering the first day after the period covered by the last report through 40 days before the election.

The Ethics Commission lifted the requirement because there is no ballot for the April 3rd election. The state’s primary election dates will likely be changed once redistricting in Texas has been finalized.

New York Senator Gustavo Rivera has introduced Senate Bill 6533 that would forbid lobbyists convicted of class D felonies or more serious offenses from lobbying in the state for three years.

The barred person may seek to re-register as a lobbyist with the Joint Commission on Public Ethics after three years.

The commission may determine if the suspension should be lifted or extended for a maximum of an additional two years.

The Los Angeles City Ethics Commission has voted to shorten the length of time during which candidates for office may conduct fundraising.

If the commission’s ruling is approved by city council, candidates for city council will have 12 months instead of the current 18 months for fundraising, and citywide candidates will have 18 months instead of the current two year period for fundraising.

The commission additionally decided to delay the vote on whether or not the campaign contribution limit should be increased from $500 to $1,100 per donor.

The Arizona House of Representatives passed House Bill 2642, which will require more disclosure for local governments who lobby the state lawmakers. Two amendments were not added to the bill – one requiring American Legislative Exchange Council (ALEC) disclosure and another that would remove the one year “revolving door” waiting period for lawmakers to become lobbyists.
