Gov. Brian Kemp signed a bill changing the name of the Government Transparency and Campaign Finance Commission back to the State Ethics Commission.

The much longer commission name was the product of a major ethics overhaul in 2010.

In addition to the name change, House Bill 572 also clarifies rules for late contribution reporting.

A contribution designated for a general election given close to a primary election date does not need reported within two days.

The new law will take effect on July 1.

The reconstituted State Ethics Commission has named Kathleen Edwards the interim director.

Edwards, who has been a commission attorney, will take the lead role until a permanent director is chosen.

The commission was merged with the State Board of Elections then was remade as a stand-alone entity again following the passage of House Bill 1029.

Edwards will have to hire a new staff and try to recover several positions the commission lost when it was merged.

Steve Hamm, attorney and former director of the South Carolina Consumer Affairs Department is now the interim director of the State Ethics Commission.

He replaced Ami Franklin, who filled the role briefly following Herb Hayden’s retirement at the end of last year.

Hamm will continue to serve as interim director while the commission is restructured. It is expected he will also oversee an overhaul of the state’s ethics laws.

Franklin has returned to her post as assistant director.

Monday, the North Carolina Supreme Court issued an order blocking Senate Bill 4 from taking effect while the legal challenge against the law is pending.

This order halts the merger to combine the State Board of Elections with the State Ethics Commission.

Gov. Roy Cooper is currently challenging Senate Bill 4 on the basis that the General Assembly overstepped its state constitutional authority when it adopted the law establishing an eight-member board to oversee elections and consider ethics complaints and issues.

Today, Governor-elect Roy Cooper filed a legal challenge against Senate Bill 4. Wake County Superior Court Judge Donald Stephens agreed to block the law from taking effect while the lawsuit is pending.

Senate Bill 4 would have taken effect January 1, 2017, to merge the State Board of Elections with the State Ethics Commission and create a new eight-member board split evenly between Republicans and Democrats. The bill was passed by a Republican dominated legislature in an attempt to limit the power of the executive branch before newly elected Democrats take power.

The Baltimore Sun reported that lobbyist Bruce Bereano has settled the ethics case with the Maryland State Ethics Commission by agreeing to pay a $2,750 fine.

Governor Nathan Deal has appointed B. Chan Caudell to replace Josh Belinfante as a member of the State Ethics Commission.

Caudell is an attorney and former commissioner of Habersham County, Georgia. He also serves on the board of directors for North Georgia Technical College and is vice chair of Common Cause Georgia as well as the State Bar of Georgia advisory committee that reviews legislation.

Belinfante resigned last week, stating he was looking into running for state senate.

Josh Belinfante, Vice Chairman of the State Ethics Commission, has announced he is resigning his position in order to consider a run for state senate. While he has yet to commit to running for the position, Belinfante has indicated an interest in the seat for senate district 6 following the release of the proposed maps for redistricting.

Belinfante’s resignation comes on the heels of the recent announcement by Chairman Patrick Millsaps that he will be stepping down from his position due to what he has determined to be his illegal appointment by Governor Nathan Deal.

The State Ethics Commission is also currently engaged in the process of finding a person to fill the role of Executive Secretary for the Georgia Government Transparency and Campaign Finance Commission following the departure of Stacey Kalberman.

Kalberman’s departure and the termination of the Deputy Executive Secretary position, once held by Sherilyn Streicker, were the result of cost-cutting maneuvers implemented by members of the Commission this past June.

The State Ethics Commission will not appeal South Carolina Citizens for Life, Inc. v Krawcheck, a federal court decision finding South Carolina’s statutory definition of committee unconstitutional. The commission has already voluntarily announced it will not enforce provisions of the law concerning committees making independent expenditures.

State Ethics Commission Executive Director Herb Hayden says groups can now both raise and spend unlimited amounts of money and likely will not have to report their donors. He and Senate Ethics Committee Chairman Wes Hayes say a new law is needed to govern committee contribution limits.
