Q: I am a registered lobbyist in Tennessee and my employer is planning to invite the entire membership of the general assembly to an in-state reception with food and beverages provided. Is this allowed and is there anything else I should know to make sure I am compliant with state laws?

 

A: Yes, the event is permissible, but there are important reporting requirements to follow.

Lobbyists and employers of lobbyists may provide entertainment, food, refreshments, etc. in connection with an in-state event to which the entire membership of the general assembly has been invited. For 2023 events, the cost per person may not exceed $73 per day.

The lobbyist or employer of lobbyist must file a copy of the invitation with the Ethics Commission at least 7 days before the event and must file an In-State Disclosure form within 30 days after the event detailing the per-person and total cost of the event.

The aggregate total of all in-state events is also reported on the semi-annual lobbyist employer reports.

Jeff Brindle, Director of New Jersey’s Election Enforcement Commission, has sued Gov. Murphy to block the recently signed Elections Transparency Act.

The new law allows the governor to directly appoint the four members of the Election Enforcement Commission without Senate oversight if within a 90-day period.

The new law also reduces the time the commission has to investigate campaign finance violations from 10 years down to two years following a violation.

The timeline change applies retroactively, effectively wiping out the majority of the commission’s caseload.

Brindle believes the new law and calls for his resignation are in response to his efforts against dark money in New Jersey’s politics.

The three other members of the Election Enforcement Commission resigned in protest two days after the new law was passed.

After the expulsion and reappointment of Justin Jones and Justin Pearson, the elections for House districts 52 and 86 have been established.

The special primary election will take place June 15 and the special general election will be held August 3.

A Santa Clara City Council member and former mayoral candidate who received campaign contributions from the San Francisco 49ers was indicted for allegedly lying about leaking information to a team employee. He also was charged with failing to perform his official duty. Florida – Ex-Venezuelan Treasurer, Husband Sentenced to 15 Years in Miami Bribery Case

Indiana – Donor Privacy or Secrecy? Nonprofit Disclosure Bill Nears Law

But the information, while technically available to the public, is challenging both to unearth and decipher – in some cases coming in the form of barely legible handwritten documents. The Minnesota Legislature is considering two bills proposing an overhaul to the lobbyist reporting requirements.

Senate File 1636 requires lobbyist principals to report the total amount, spent by the principal during the preceding calendar year on each of four types of lobbying:

1. Lobbying to influence legislative action
2. Lobbying to influence administrative action
3. Lobbying to influence official action of political subdivisions
4. Lobbying to influence administrative action in cases of rate setting, power plant and powerline siting, with no rounding of the amounts, so lobbyist principals will be reporting actual amount spent for each category of lobbying.

House File 1723 requires lobbyist principals to report the total amount, rounded to the nearest $10,000 spent by the principal during the preceding calendar year on each of four types of lobbying:

1. Lobbying to influence legislative action
2. Lobbying to influence administrative action
3. Lobbying to influence official action of political subdivisions
4. Lobbying to influence administrative action in cases of rate setting, power plant and powerline siting, and granting of certificates of need for a large energy facility.

Currently principals are only required to report the total amount, rounded to the nearest $20,000, for all categories.

The Virginia Legislature officially passed and adopted Gov. Glenn Youngkin’s recommendation concerning Senate Bill 1427, which relates to campaign finance laws, political action committees (PACs), and certain large pre-election expenditures.

The bill changes some of the reporting dates while also adding an additional report.

The reports previously due on July 15 and October 15 will be due on June 1 and September 15 with an additional report due on October 15.

PACs must also report any single contribution received or expenditure made of $1,000 or more between the dates of May 26 and the third Tuesday in June, and between October 8 and the date of the November general election.

The bill will take effect on July 1.

The 445th Maryland General Assembly adjourned from their 90-day session on April 10.

Passed legislation includes the Fair Wage Act of 2023 and the Family Prosperity Act of 2023.

These bills are aimed toward reducing child poverty and raising the minimum wage which will increase wages for approximately 163,000 workers, and ultimately benefit 120,000 children in the state.
