The Iowa Ethics and Campaign Disclosure Board voted unanimously to issue an advisory opinion classifying political donations in cryptocurrencies like Bitcoin and Ethereum as in-kind contributions.

Candidates may accept payments but must report the cash value and the donor’s name, and they must report when a cryptocurrency is sold and to whom.

The opinion notes campaigns cannot spend cryptocurrency directly because all campaign expenditures must come from money deposited into an Iowa financial institution.

The Cincinnati City Council voted unanimously to approve the first-ever code of conduct for council members and their staff.

All council members and their staff must sign a copy of the code of conduct and file it with the clerk.

Future council members and staff must sign the document within 45 days of taking office or starting the job.

Mayor Aftab Pureval was also required to create and sign a code of conduct, which he signed and released after the council vote.

It is nearly identical to the council version except the provisions regarding the city’s economic development.

The Office of City Solicitor chose Chris Liu, Chief Hearing Examiner, to be the city’s first head of the new Ethics and Good Government Division.

Two staff members have also been hired for the division, which is working to implement a new hotline for reporting ethics and fraud violations and to expand online resources for viewing campaign contributions.

New Mexico’s 30-day legislative session adjourned sine die at noon February 17.

During the session, a bill that would require post-session lobbying reports was introduced.

Senate Bill 61 provides prior to the adjournment of a legislative session, a lobbyist or lobbyist’s employer that is required to file an expenditure report or registration statement must file a report with the secretary of state disclosing the lobbyist’s or lobbyist’s employer’s lobbying activity on legislation and identifying the specific legislation lobbied, the support, opposition or other position taken on the legislation by the lobbyist or lobbyist’s employer and the name of the lobbyist’s employer that lobbied on the legislation, either directly or by the registered lobbyist.

The bill is currently in the Senate Rules and Health and Public Affairs Committees.

If passed, it would become effective May 18.

In July 2020, Schweikart was fined $50, 000 by the House ethics committee for the same set of violations. He admitted to 11 different violations of House rules, leading to a formal reprimand.

A restrictive new voting law in Texas has sown confusion and erected hurdles for those casting ballots in the state’s March 1 primary, with election administrators rejecting early batches of mail ballots at historic rates and voters uncertain about whether they will be able to participate. In recent days, thousands of ballots have been rejected because voters did not meet a new requirement to provide an identification number inside the return envelope. The rejection rates provide an early opportunity to assess the impact of Senate Bill 1, one of dozens of restrictive voting laws enacted by Republicans across the country last year.

Lawmakers created Vermont’s first-ever state ethics commission in 2017 after years of public pressure from government transparency groups and the press. But for good government advocates, the resolution was inadequate. The commission had no investigative or enforcement powers and basically nothing to enforce since no single statutory code of ethics covers all three branches of government. Attempts at reform in the past five years have gone nowhere and a new attempt to make progress on the subject this legislative session is on shaky ground.

A top deputy overseeing election issues for Virginia’s new Republican attorney general resigned after The Washington Post questioned the office about Facebook posts she had made praising January 6, 2021, rioters and falsely claiming Donald Trump won the 2020 election. Former Deputy Attorney General Monique Miles also espoused unfounded conspiracy theories about voter fraud and election interference in more than a dozen Facebook comments that spanned months.

Former Seattle Mayor Jenny Durkan’s text messages from one of the most tumultuous periods in city history vanished because a phone setting likely was manually changed to delete texts automatically, and ex-Police Chief Carmen Best deleted her texts, a forensic analysis has found. The analysis, which tried but failed to recover the texts and investigated what happened to the public records, including messages exchanged during Seattle’s racial justice protests in the summer of 2020, indicated Durkan’s texts were set in July 2020 to delete after 30 days, and that Best’s texts were “periodically deleted.”

Wisconsin – Wisconsin Supreme Court Allows Lower Court’s Ban on the Use of Ballot Drop Boxes for April Election

A closely divided Wisconsin Supreme Court ruled it would allow a lower court decision to go into effect that will ban the use of ballot drop boxes for the April election. Drop boxes can still be used for primaries and it is possible the high court will change course and allow them for other elections. While a final decision is yet to come, the ruling suggests the use of ballot drop boxes could soon come to an end in Wisconsin. Drop boxes became popular during elections in 2020 as the coronavirus spread across the state.

Gov. Tony Evers signed Executive Order 156 calling for a special session of the Wisconsin Legislature to begin Tuesday, March 8.

Evers wants lawmakers to consider his plan to use a portion of the state’s $3.8 billion projected surplus to provide a $150 surplus refund to every Wisconsin resident, provide targeted relief for childcare and caregiver costs, and invest in education.

How do you help our clients?

I make sure that if a client makes direct state corporate contributions, they are abiding by the state corporate reporting requirements.  For some of our clients, I vet their corporate contributions for compliance with the states’ contribution limits, reporting requirements, restrictions on contributions during legislative session, pay-to-play restrictions and reporting requirements, and restrictions on contributions from lobbyists. For other clients, I pre-clear their employees’ personal political contributions. I ensure that clients file the required pay-to-play reports. If one of our clients is selected for a state audit of its lobbying reports, I draft the response and submit it to the auditor.

On February 18, a Special Legislative Meeting of the Council of the District of Columbia will be held.

Chairman Phil Mendelson is calling the 13 councilmembers to come together under Council Rule 303(b) to consider legislation concerning COVID-19 vaccine mandates in the District, specifically the Public Health Protections Emergency Declaration Resolution of 2022 and the Public Health Protections Emergency Amendment Act of 2022. Nine votes are required to pass the emergency legislation. Additionally, the legislation cannot have costs associated with it.

This announcement came in part in reaction to Mayor Muriel Bowser lifting the requirement that District businesses check the vaccine status of patrons, according to WTOP News.

Gov. Greg Gianforte and Republican lawmakers announced they are looking into holding a special session to redraw Montana’s Public Service Commission districts.

Gianforte asserted he will only call a special session if it is limited to the solitary topic of redrawing, but a few Republicans wish to expand the special session.

Rep. Derek Skees wishes to address “election integrity,” requesting $250,000 to create a committee to examine election security.

The schism over the scope of the special session might take the issue out of the Legislature’s hands entirely.

A lawsuit is already pending in federal court over the population imbalance within districts.

If a special session is not called to amend the deficiency, the task will be turned over to a panel of three federal judges.

If Skees can garner a majority of lawmakers for his cause, the special session can be called without the governor’s approval.

On March 15, a by-election will be held to elect a member to the Legislative Assembly of Alberta for the electoral division of Fort McMurray-Lac La Biche.

After a six-month wait, and on the last possible day authorized by law, Alberta Chief Electoral Officer Glen Resler confirmed a writ was issued on February 15 to administer the election. MLA Laila Goodridge resigned in August 2021, to run for federal office. On September 20, 2021, she was elected as a Member of the Parliament in the House of Commons for Fort McMurray—Cold Lake.

Candidate nominations are now open and will end on February 25, 2022.

The San Francisco Ethics Commission will hold a special remote meeting Friday, February 25, at 10 a.m. to discuss proposed amendments to the city’s gift and ethics laws.

The meeting will focus on amendments to expand the definition of who is a restricted source and whether the giver of an unlawful gift should be subject to penalties.

The proposed amendments clarify and remove exemptions to the gift prohibition.

If the Ethics Commission passes an ordinance by a four-fifths vote before the next general election, the commission may place the ordinance on the ballot.

The Tallahassee City Commission is holding an ethics workshop to discuss and consider several proposed changes to the city’s ethics ordinances.

The proposals by the city’s Independent Ethics Board include clarifying the definition of lobbyist and expanding disclosure requirements.

Other proposals include broadening the board’s jurisdiction and the city’s whistleblower protections.
