The Kansas Legislature adjourned its regular session sine die in the early hours of Saturday, April 2.

During the session, several bills related to campaign finance were introduced but not passed.

House Bill 2707, related to political advertising, sought to define corrupt advertising as communications that do not disclose the name of the sponsoring organization and of the chairperson, treasurer, or other individual responsible for the ad.

The last action on the bill was a referral to the Election Commissar on February 15.

Lawmakers successfully passed an unconstitutionally gerrymandered congressional map and a $22 billion state budget plan that contained a raise for state workers.

Issues that weren’t resolved are expected to be taken up during a veto session, which is slated to begin Monday, April 25.

This does not affect lobbyist reporting.

Every week we discuss the articles from lobbycomply.com and see which ones are opened the most often. No question about it, Ask the Experts—Employee Personal Political Contributions is the #1 blog post…Every single week.

The question is easy—”Before I can make a political contribution using my own funds, my employer requires that I obtain permission first.  Can my employer legally do this?”

As is the answer—Yes.

Employers may require employees to seek preapproval before making personal political contributions. Not only can your employer require this, but it’s also smart business to do so. Employers may even require preapproval from family members of employees.

This preapproval requirement has evolved because of the increased number of jurisdictions enacting pay-to-play laws. A seemingly innocuous contribution by an employee could result in the loss of government contracts, fines, and a ban on future contracting. Criminal sanctions may apply when repeated violations occur. By requiring pre-approval, your employer can properly vet the contribution for compliance with a jurisdiction’s pay-to-play law, including disclosure requirements.

In most jurisdictions, employees covered by pay-to-play laws include officers, partners, directors, senior management, salespersons, and their spouses and dependent children. In Pennsylvania and Kentucky, all employees are covered in the instance of a no-bid contract.

Requiring preclearance of employee personal political contributions is certainly preferable than imposing a ban on employee contributions, which could result in a violation of applicable labor laws. Various jurisdictions bar employers from retaliating against employees for engaging in political activities, which can include everything from participating in a political rally to making campaign contributions. Even though an employer can require preapproval, an employer cannot directly or indirectly affect an individual’s employment by means of discrimination or threat of discrimination based on the individual’s personal political contributions.

We have a busy election year ahead of us…and it continues until November 2024. Protect the company and ask before making political contributions. As I always say, this is not an issue where you can ask for forgiveness first…Obtain permission before proceeding.      I suggest you always plan your contributions before saying YES to the candidates calling and sending invitations. Make sure you do not exceed the limitation in the jurisdiction.

On April 1, 2022, Elections Canada published the updated limits on expenses for regulated activities of third parties involved in federal elections in Canada. The Canada Elections Act imposes a limit on expenses a third party can incur for regulated political activities.

For the period of April 1, 2022, to March 31, 2023, a third party is prohibited from incurring overall election advertising expenses of a total amount of more than $543,200 during a general election. The previous limit was $525,700.

For the same period of April 1, 2022, to March 31, 2023, a third party is prohibited from incurring election advertising expenses in a given electoral district of a total amount of more than $4,656 during a general election. The previous limit was $4,506.

Adjustments are made annually based on a formula of a base amount multiplied by the inflation adjustment factor in effect for the period.

The Idaho State Legislature adjourned sine die March 31.

The 81-day session focused mostly on infrastructure and education.

Starting the session with a nearly $2 billion surplus and billions in federal covid relief funds, lawmakers approved Gov. Brad Little’s “Leading Idaho” plan, providing $300 million to bolster k-12 public school budgets, a 7% increase in educator salaries, and funding an optional full-day kindergarten program.

Lawmakers also passed a bill modeled after the Texas abortion ban, the most restrictive abortion law in the country.

Planned Parenthood since filed a lawsuit with the Idaho Supreme Court requesting an injunction.

This does affect lobbyist reporting.

A lobbyist activity report will be due April 15, covering March 1 through March 31.

Airbnb is not the only tech company to generate seemingly grassroots campaigns. Judge Matthew Norwood concluded their activities did not meet the definition of lobbying.

Ammon Bundy, the anti-government activist running as an independent candidate to be Idaho’s next governor, has paid thousands of dollars in campaign donations to a company he owns. Bundy’s campaign has paid $13,500 in $1,500 monthly installments since June 1, 2021, to Abish-Husbondi Inc, a company incorporated in Wyoming. Bundy is listed as the company’s president and sole officer in an annual report. Idaho law states that, in general, “A contribution shall lot be converted by any person to personal use.” But the law appears silent on whether candidates can contract with their own businesses.

ComEd won because, according to federal prosecutors, Michael Madigan paved the way. Kansas – Kansas Governmental Ethics Leader Under Fire Amid Law License Questions. Legislature Eyes Response.

Records from FirstEnergy’s Maryland utility show some of its customers’ monthly payments in 2017 were secretly flowing to a “dark money” group formed to help further former President Trump’s agenda. The records show Potomac Edison paid $163,000 that year to America First Policies, which was founded by some of Trump’s top administration and campaign officials. The America First payment, made around the time FirstEnergy was pressing the Trump administration for help to rescue coal and nuclear plants, was revealed as part of an ongoing Maryland Public Service Commission investigation. It is among millions of dollars in payments by FirstEnergy and its subsidiaries to groups that are not required to list their donors.

Maryland – Judge Throws Out Maryland Congressional Map Over ‘Extreme’ Gerrymandering

A Maryland judge threw out the state’s congressional map, calling it an “extreme partisan gerrymander” in what is a victory for Republicans. The ruling by Anne Arundel County Senior Judge Lynne Battaglia marks the first time in Maryland history a judge has found a congressional map violated the state constitution. Battaglia ruled the map ran afoul of rules laid out in the law traditionally applied to legislative districts, requiring them to be compact and to give regard to political subdivisions. She also ruled the map violated the state constitution’s equal protection, free speech, and free elections clauses.

The board launched an inquiry into the couple’s spending after both filed reports claiming legal costs paid out to multiple law firms as campaign expenses. State law prohibits any candidate or political committee from using campaign funds for legal expenses related to investigations or court proceedings that “do not have a direct connection with the candidacy.”

Federal investigators issued subpoenas and are seeking information about grants related to New York Lt. Gov. Brian Benjamin’s time as a state senator. Investigators with the Southern District of New York have subpoenaed state officials and Senate employees as they probe money Benjamin steered toward projects in his former district. The inquiry is related to funds doled out through the State and Municipal Facilities Program, a lump sum appropriation in the state budget administered through the Dormitory Authority of the State of New York.

Ohio – Ohio’s High Court Suggests No Ruling Before Primary on Redistricting Map

Republicans submitted a new, minimally altered map in March that Democrats and voting rights groups complained was no better. South Carolina – SC Ethics Commission Stops Silencing Whistleblowers After Free-Speech Lawsuit

The South Carolina Ethics Commission reversed a three decades-old policy preventing anyone who files a complaint against a public official from talking about it unless the complaint is found valid. The decision came after a whistleblower whose complaint was dismissed by the commission sued and said the secrecy violated free speech rights and unfairly silenced people who wanted to report wrongdoing. Leaders in the state Legislature filed documents in the lawsuit saying they never intended for the state’s ethics laws to silence whistleblowers.

Neither firm employs registered lobbyists, but Link runs public affairs campaigns designed to influence legislators. A power plant near Grant Town, West Virginia, is the link between the coal industry and the personal finances of U.S. Sen. Joe Manchin. Although the fact that Manchin owns a coal business is well known, an examination by The New York Times offers a more detailed portrait of the degree to which Manchin’s business has been interwoven with his official actions. He created his business while a state lawmaker. Manchin supplied a type of low-grade coal mixed with rock and clay known as “gob” that is typically cast aside as junk by mining companies but can be burned to produce electricity. The Grant Town plant has been the sole customer for his gob for the past 20 years.

Patricia Guerro has been sworn in as one of the seven judges on the bench of the California Supreme Court.

Gov. Newsom appointed Guerro to the court after Justice Mariano-Florentine resigned to become president of the Carnegie Endowment for International Peace.

Prior to her appointment, Guerro served as a judge for California’s Fourth District Court of Appeal, Division One.

The Massachusetts Office of Campaign and Political Finance (OCPF) revised the state’s campaign finance regulations to address issues related to payment applications, the depository reporting schedule, and independent expenditures.

Under the revised regulations, contributions may be received through peer-to-peer payment applications.

The revised regulations also flesh out the rules surrounding independent expenditures made by traditional PACs and ballot question committees and update the depository reporting schedule to match the schedule contained in G.L. §55-19.

The revised regulations are now in effect.

Gov. Jim Justice vetoed Senate Bill 729, citing technical errors in the bill.

Gov. Justice plans to call a special session of the West Virginia Legislature to address the errors in the economic development bill, which creates a self-sustaining loan fund managed by the West Virginia Economic Development Authority.

The special session will coincide with the Legislature’s interim meetings scheduled between April 24 and April 26.

Florida Gov. Ron DeSantis has vetoed Senate Bill 102 establishing the new congressional districts, citing the new maps were in violation of the 14th Amendment.

Further, Gov. DeSantis has called a special session of the Florida Legislature to address the rejected maps.

The special session will convene on April 19 and can adjourn no later than April 22.

Today is the last day for all federal agencies to have ensured they have incorporated a $15 minimum wage in any of their new contract solicitations.

On April 27, 2021, President Joseph R. Biden had signed an executive order requiring federal contractors to pay $15 per hour for employees working on or in connection with a federal government contract. On November 22, 2021, Secretary of Labor Martin J. Walsh announced the final rule implementing the president’s order. In turn, on March 30, 2022, all federal agencies need to implement the minimum wage into new contracts.

Federal agencies are also directed to implement the higher wage into existing contracts when the parties exercise their option to extend such contracts. Contractors and subcontractors must certify they will meet this condition requiring the minimum wage. This certification is a condition of payment to the contractors from the government. The order applies, with certain exceptions, to any new contract; new contract-like instrument; new solicitation; extension or renewal of an existing contract or contract-like instrument; or exercise of an option on an existing contract or contract-like instrument.

This order does not apply to grants; contracts, contract-like instruments, or certain specific type of agreements with Indian Tribes.

Starting January 1, 2023, the minimum wage will be adjusted annually, but not lowered, by the U.S. secretary of labor based on a consumer price index formula and rounded to the nearest multiple of $0.05. For tipped workers, the minimum wage mandated by the order is $10.50 per hour beginning January 30, 2022. Beginning January 1, 2023, tipped workers must receive 85% of the wage rate in effect for non-tipped employees, rounded to the nearest multiple of $0.05.

Then beginning January 1, 2024, and for each subsequent year, tipped workers must receive 100% of the wage received by non-tipped worker, eliminating the difference between the type of workers. Adjustments must be considered by employers of tipped workers who do not receive a sufficient additional amount on account of tips to equal to the minimum wage of non-tipped workers. If a state or municipality has a higher minimum wage, the Executive Order does not excuse noncompliance with the laws requiring the higher wage.
