New York City Mayor Bill de Blasio announced a special election to be held on December 22 for City Council District 12.

The seat is vacant after the expulsion of Bronx Councilman Andy King for accusations of sexual harassment, misuse of city resources, and other ethics violations.

The winner of the special election will serve the remainder of King’s term through 2021.

The Legislative Ethics Commission unanimously recommended that the 2020 General Assembly pass legislation prohibiting legislators and lobbyists from engaging in sexual and workplace harassment against legislative employees, other legislators, and lobbyists.

In past cases involving allegations of sexual harassment, the commission has followed more general ethics laws relating to the misuse of office.

The recommended change would add specific workplace protections into the legislative ethics law and categorize sexual harassment as ethical misconduct, punishable by fines or other sanctions.

The commission also recommended that the ethics law be amended to grant the commission the authority to adjudicate a complaint filed against a legislator, even if the legislator leaves office after the complaint is filed, as long as the complaint is based on action that occurred not more than a year prior to the day the legislator left office.

During the 2019 session, several bills relating to sexual harassment were filed but none were approved by the legislature.

New Mexico State Reps. Joy Garratt and Elizabeth Thomson introduced House Bill 551 earlier this month.

If passed, the bill would require lobbyists to participate in a sexual harassment training lasting at least four hours.

The program must be sponsored by the secretary of state, an employer of the lobbyist and conducted by a person qualified to conduct the training, or by a certified human resources professional.

New Hampshire lobbyists received a letter from the General Court last week confirming they are covered by the Legislature’s sexual harassment policies and procedures and should report any harassment they experience.

According to the letter, the State House is not only a workplace for legislative staff, Senators, and Representatives, but also for lobbyists and there is a duty to protect all individuals working there.

The letter follows a story by New Hampshire Public Radio about routine sexual harassment and casual sexism at the State House.

State House staff and lobbyists can report harassment by following procedures established by the Legislative Ethics Committee.

Lawmakers passed a series of bills during the fall veto session this week aimed at curbing sexual harassment within state government.

Among them, Senate Bill 402 expressly prohibits sexual harassment by lobbyists, provides for a $5,000 fine for violations, and requires lobbyists to take an annual sexual harassment training course. The Secretary of State’s inspector general is also granted additional authority to investigate reports of sexual harassment.

The measure unanimously passed both houses and now awaits the governor’s signature.

Former federal prosecutor Julie Porter has been appointed as temporary inspector general after reports surfaced of harassment claims going unnoticed for more than a year while the post was vacant.
