The Chicago Board of Ethics issued a press release and three binding advisory opinions.

These opinions clarify what does and does not constitute lobbying activity by nonprofit organizations.

The opinions include a total of 44 scenarios or hypothetical situations addressing concerns raised by the nonprofit community in response to recently passed amendments to lobbying laws.

Effective April 20, Ethics Ordinance 2019-5305 imposes new registration and reporting requirements on certain nonprofit interactions with the city.

On June 8, the Department of Justice’s (DOJ) Foreign Agents Registration Act (FARA) Registration Unit released several years’ worth of advisory opinions previously unavailable to the public.

The advisory opinions, covering the period from January 1, 2010, to the present, had been previously issued to individuals and lobbyists concerning registration and other issues falling under FARA. 49 advisory opinions concerning FARA have been issued by the DOJ since January 1, 2010.

Also included with the release of the advisory opinions are three additional letters sent in response to requests for general information.

Future advisory opinions will be made publicly available and posted on the DOJ’s website periodically.

The New York Joint Commission on Public Ethics (JCOPE) released a set of proposed lobbying regulations on October 13, 2016. The comprehensive regulations expand the definition of lobbying to include indirect lobbying, like setting up a meeting between a legislator and a lobbyist.

According to JCOPE, the purpose of the proposed regulations is to fully incorporate existing guidelines and decades of advisory opinions.

JCOPE is seeking public comment on the staff proposed regulations until November 21, 2016. Drafts of the rules may be found at http://www.jcope.ny.gov/advice/staffproposal.html.
