The Assembly adjourned early on Saturday, June 18, two days later than scheduled.

In light of corruption convictions for former Speaker Sheldon Silver and Senate Majority Leader Dean Skelos, ethics reform was a primary focus of this term. The Legislature came to agreement on a five-point reform plan, including Assembly Bill 10739, which allows courts to reduce or revoke pensions for lawmakers convicted of felony-level corruption charges related to their responsibilities as public officials.

The bill is a constitutional amendment, so lawmakers will have to hold another vote at the beginning of the next regular session before voters will decide whether or not to accept the measure.

Rep. Steve McLaughlin is seeking bipartisan support for a package of ethics reform bills. The bills seek reform on multiple fronts by lowering the permissible amount individuals, unions, corporations, lobby groups, or businesses can donate to a PAC; increasing disclosure requirements for pay-to-play lobbying; placing eight-year term limits on legislative leaders; and stripping pensions from those convicted of public corruption offenses.

The proposed bills come in response to former Assembly Speaker Sheldon Silver’s recent 12-year prison sentence for conviction on multiple corruption charges.

Governor Cuomo has set a special election date for two vacant state Assembly seats and one vacant state Senate seat. Elections will be held on April 19, 2016, aligning with the date for New York’s presidential primary.

Elections will fill vacant seats in Assembly District 59 following the election of former Representative Roxanne Persaud’s to the state Senate, as well as in Assembly District 65 and Senate District 9 following the criminal convictions of former Representative Sheldon Silver and former Senator Dean Skelos.

Former Assembly Speaker Sheldon Silver was expelled from the legislature on November 30, 2015, after being found guilty of abusing his power to collect over four million dollars in illegal bribes and kickbacks.  Silver’s conviction triggered the automatic expulsion from the Assembly, and Silver faces a maximum of 130 years in prison.

Silver, who is currently free on bail, vowed to appeal the conviction.

State Rep. Sheldon Silver will no longer be speaker of the New York State Assembly beginning Monday, February 2, 2015. Silver was arrested on federal corruption and bribery charges earlier this month. It is not clear whether Silver is resigning voluntarily or being forced out by a vote.

Silver said, “I won’t hinder any succession process . . . [but] I will be a member of this house. I was elected by my constituents and I do not intend to resign my seat in this house.”

Assembly Majority Leader Joe Morelle will serve as the acting speaker until an election for a new speaker is held on February 10, 2015.

Assemblyman Sheldon Silver, speaker of the New York State Assembly, was arrested on federal corruption charges. He is accused of taking millions of dollars in bribes. Mr. Silver, a Democrat, has served as speaker for more than 20 years.

According to the New York Times, the corruption charges stem from accusations of using his position to obtain corrupt payments misrepresented as referral fees from a law firm; funneling state research funds and other benefits to a doctor who in return referred asbestos claims to the law firm where the speaker worked; and secretly helping real estate developers win tax breaks.

In New York, state legislators who are charged with crimes can continue to serve unless and until convicted of a felony, at which point the legislator must leave office.
