On December 9, the Legislative Assembly of Ontario passed an omnibus bill that includes changes to the province’s Lobbyists Registration Act, 1998.
Schedule 8 of Bill 8, the Accountability and Transparency Act, gives the Ontario Integrity Commissioner as Lobbyist Registrar more enforcement power for violations. Individuals found in violation can be prohibited from lobbying for up to two years. Among other changes, the bill creates a 50 hour per year threshold of lobbying activity to meet the Act’s definition of in house lobbyists.
Schedule 8 comes into force on a day to be named by proclamation of the Lieutenant Governor.

On July 24, the Ontario, Canada, Legislature adjourned its session with unanimous consent until October 20, 2014. According to The Record, legislators will continue to work over the summer to address budget issues. “Make no mistake, this is not an extended vacation that MPPs are going on, and certainly I will be working very hard over the coming weeks to prepare for all the implementation that comes with the passage of the budget,” said Premier Kathleen Wynne.

Today the Chief Electoral Officer for Ontario, Canada, Greg Essensa, announced the province will hold general elections on June 12, 2014. According to the Elections Ontario’s press release, the candidate nomination period runs from May 15 to May 22. The two blackout periods on political advertising run from May 7 to May 20 and June 10 to Election Day.
The last provincial general election was held on October 6, 2011.

On April 9, the Ontario, Canada Legislative Assembly held a second reading of Bill 179, which would amend the province’s Lobbyists Registration Act.
The bill, introduced on March 24, redefines “in-house lobbyist” to include paid directors as well as employees and paid directors whose lobbying duties, when combined with those of the employer’s other employees and paid directors, would constitute a significant part of the duties of one employee or director.
The bill requires a single filing of returns by the senior officer of the employer instead of requiring in-house lobbyists themselves to file returns.
Additional amendments to the filing procedures include requiring returns to indicate whether the lobbyist was previously in public office, what the goal of the reported lobbying was, and to provide the name of any minister, member, or member of the minister’s or member’s staff who was lobbied.
The bill also increases penalties for convictions of any offense from a maximum fine of $25,000 to a maximum fine of $25,000 for a first offense and a maximum fine of $100,000 for subsequent offenses.

Information on the Canadian municipality’s website includes a list of the nominated candidates, candidate nomination forms, and other resources. Additional material will be added to the website, such as include voter registration information, election employment opportunities, and key election dates. City clerk Helen Finn, as quoted the Cornwall Seaway News, said, “The website will be updated weekly, or as required.”
The next municipal election is scheduled for Monday, October 27, 2014.

The Ontario, Canada, Legislature’s Standing Committee on Regulations and Private Bills is considering changes to the province’s Lobbying Act. Bill 115, Lobbyists Registration Amendment Act, 2013, introduced last month, makes several amendments to the Lobbyists Registration Act, 1998. These changes include requiring consultant lobbyists to register within five business days of beginning to lobbying, requiring lobbyists to file monthly reports when lobbying high-level public officeholders, and requiring consultant lobbyists to report political contributions if the Election Finance Act applies.
This bill also provides a new definition of grassroots communication and amends the definition of in-house lobbyist. Additional requirements and changes regarding penalties, revolving-door restrictions, and protections are also a part of Bill 115.
According to a bulletin by Fasken Martineu, LLP, the Progressive Conservatives are critical of the bill and the Liberal Government “would prefer to introduce its own lobbying law reforms.”

Call to Alter Ontario Lobbying Laws
“Times Have Changed”
Ontario Integrity Commissioner Lynn Morrison has called for changes to the province’s Lobbyists Registration Act.
Commissioner Morrison, who is also the Lobbyist Registrar, recommends eliminating the “significant part of duties” threshold for registration of lobbyists. Currently, lobbyists must register only if they spend 20 percent or more of their time on lobbying activities. Ms. Morrison recommends all paid lobbyists register regardless of the time spent lobbying.
She also recommends the Lobbyists Registrar have the power to issue administrative monetary penalties and to introduce and require new categories of information reporting for lobbyists. Additionally, the commissioner recommends the different distinctions between the two types of in-house lobbyists be eliminated.
In an Office of the Integrity Commissioner press release, Commissioner Morrison said, “The registration system has worked well since it was introduced in 1999, but times have changed. The roles of lobbyists and public officials have evolved, making it even more important that a registry provide clear, accessible information on who is lobbying whom, and about what.”
