On March 17, a comprehensive bill aimed at reforming U.S. campaign finance, lobbying, and ethics laws, and improving voter rights and election integrity, was introduced in the U.S. Senate. The sweeping bill, Senate Bill 1, For the People Act of 2021, is companion legislation to House Bill 1, which passed the House on March 3. That bill, also called the For the People Act of 2021, was received in the Senate on March 11.

The bill would require the registration as a federal lobbyist for those counseling in support of lobbying contacts; require super PACs, 501(c)4 groups and other organizations spending money in elections and on judicial nominations to disclose donors who contribute more than $10,000; and, under the definitions of the Federal Election Campaign Act, add “paid internet or paid digital communication” to the definition of public communication and add “qualified internet or digital communication” to the definition of electioneering communication.

The bill creates a reporting requirement under campaign finance laws for disclosing certain foreign contacts and creates an obligation for political committees to notify the Federal Bureau of Investigation and the Federal Election Commission of those contacts. It also prohibits foreign nationals from participating in decision-making about contributions or expenditures by corporations and other entities; prohibits the establishment of a corporation to conceal election contributions and donations by foreign nationals; and requires foreign agents to disclose transactions involving things of financial value conferred on officeholders.

The bill defines the prohibited coordination between campaigns and super PACs, includes creating a “coordinated spender” category in the law to ensure single-candidate super PACs do not operate as arms of candidates, and defines the prohibited coordination between campaigns and super PACs. The bill would repeal existing prohibitions on the Securities and Exchange Commission from finalizing rules to afford shareholders the opportunity to know about the political spending of publicly traded companies and would require shareholder authorization before a public company may make certain political expenditures. It would also repeal existing prohibitions on the executive branch from promulgating rules to require government contractors to disclose all of their political spending.

The bill requires presidential inauguration committees to disclose their expenditures, limits aggregate contributions, and restricts funds being used for purposes unrelated to an inauguration. Additional measures in the bill include a publicly financed 6-1 matching system on small-dollar donations for Senate and presidential candidates, more ethics changes to the executive branch, and substantial changes to federal election law and voter rights.

The Nevada Legislative Counsel Bureau activated the lobbyist registration function on their website due to the passage of Assembly Bill 110.

Lobbyists will now be able to complete registration statements for the 81st Session of the Nevada Legislature.

Pursuant to Assembly Bill 110, a lobbyist must file a registration statement not later than 14 days after March 18, 2021, or not later than 2 days after the beginning of the person’s lobbying activity, whichever date is later.

A lobbyist must also include in the first report filed after March 18, 2021, information concerning the person’s lobbying activities during the period beginning on February 1, 2021, and ending on March 18, 2021.

The 55th New Mexico Legislature is set to adjourn sine die March 20.

During the session, several bills were introduced relating to lobbying and campaign finance.

Two key bills related to lobbying and the legislative session are advancing through the Legislature.

House Joint Resolution 13, relating to the legislative session, proposes to change the date each regular session of the Legislature begins and seeks to remove the restrictions on bills that may be considered in even-numbered years and the date laws would go into effect after adjournment sine die.

Under the bill, the legislative session would convene on the third Tuesday of February rather than January and would remain in session no longer than 45 days instead of thirty.

Additionally, bills would go into effect 75 days rather than 90 days after adjournment of the session.

If passed, House Joint Resolution 13 would be submitted to voters for their approval or rejection at the next general election or at any special election prior to that date that may be called for that purpose.

Separately, House Bill 244, relating to ethics commission responsibilities for campaign reporting and lobbyist regulations, provides the ethics commission, in consultation with the secretary of state, must issue advisory opinions when requested.

The bill designates the ethics commission, rather than the secretary of state, to receive any complaints regarding a violation of the Campaign Reporting Act.

Under the bill, the secretary of state may promulgate rules to implement the provisions of the Lobbyist Regulation Act.

If passed, House Bill 244 would become effective July 1, 2021.

Legislation not acted upon by Gov. Michelle Lujan Grisham will be pocket vetoed on April 9, meaning passed bills will become law without her signature.

Gov. Steve Sisolak signed Assembly Bill 110, which revises the Nevada Lobbying Disclosure and Regulation Act.

The bill changes the definition of a lobbyist by removing the requirement to appear in person at the Capitol building or any other building the Legislature or their committees hold meetings.

Currently, lobbying is taking place virtually because the legislative session is closed to all but lawmakers, essential staff, and some members of the media.

However, lobbyist registration has not taken place because the definition required in-person communication.

Assembly Bill 110 became effective upon being signed by the governor.

While foreign disinformation and interference was a major concern heading into the 2020 campaign, domestic efforts to disrupt the race, including by Trump and his allies, turned out to be of greater significance.

Brian Jones introduced the bill because of the delay current procedures have on keeping the public informed.

Hawaii – Hawaii Lawmakers Seek Exemption from Political Ad Disclosures

The city asked for more details about the vaccination event from its organizer, Loretto Hospital. As coronavirus virus cases plummeted, Iowa quietly extended a $3.9 million contact tracing contract with a company owned by a major Republican Party donor and supporter of Gov. Kim Reynolds. After a one-day emergency bidding process in November, the state Department of Public Health hired MCI, a telemarketing firm, to trace the contacts of residents infected with COVID-19. The award of the two-month, $2.3 million contract came during a surge in cases that filled up hospitals with patients and after months of complaints from counties about a shortage of contact tracing workers. MCI performed telemarketing and data work for Donald Trump’s two presidential campaigns and also provided services for Reynolds’ political campaign.

Baltimore’s Board of Ethics clarified the voting rules for the city spending panel, finding a member may in fact vote on matters pertaining to units of city government under his or her control. In a written opinion, the ethics panel concluded a 2013 change to city law limits instances in which members of the Board of Estimates must abstain from voting because of a conflict-of-interest. “… However, the BOE is free to adopt additional voting abstention policies to avoid even the appearance of a conflict of interest,” the opinion states.

Maryland – Ex-Baltimore Mayor’s Associate, the Final Defendant in ‘Healthy Holly’ Case, Sentenced to 2 Years in Prison

The final defendant in the case against former Baltimore Mayor Catherine Pugh ended when the former director of a nonprofit job training center was sentenced to 24 months in federal prison on tax fraud charges. Roslyn Wedington was director of the Maryland Center for Adult Training, where Pugh served on the board of directors. Pugh aide Gary Brown helped Wedington earn an off-the-books salary so she could for years avoid paying taxes and wage garnishment.  Brown was sentenced to 27 months in prison for his role, as well as a fraud scheme related to Pugh’s “Healthy Holly” children’s books. Pugh is serving a three-year sentence in federal prison.

The Boston Municipal Lobbying Compliance Commission recently adopted lobbying regulations to complement the city’s lobbyist registration and regulation ordinance.

Effective immediately, clients or lobbying entities required to file reports must itemize all expenditures exceeding $35 on any day during a covered reporting period.

Expenditures not exceeding $35 on any day must be reported but is not required to be itemized.

For the purposes of lobbying, expenditures are any expense incurred or paid separately by a lobbying entity or client during the reporting period in connection with each decision, legislation, legislative action or administrative action of a city employee that it sought to promote, oppose or influence and the total amount thereof incurred or paid separately by such lobbying entity or client during the reporting period.

 

Expenditures include operating expenses such as the cost of clerical and administrative staff salaries or wages, equipment, and facilities related to a lobbying entity or client engaging in lobbying activity and specific expenditures for lodging, meals, gifts, transportation, entertainment, advertising, public relations, printing, mailing, and telephone.

The regulation also provides a definition for compensation; a lobbyist registration exception for technical service experts; fee waiver requirements; and authorizes the commission’s power to initiate a formal investigation, hold hearings, issue decisions, and enforce penalties.

More than 100 groups called for the dismissal of charges last summer, but prosecutors aggressively pursued them, arguing tSahouri and Robnett did not comply with police orders to leave the chaotic scene and interfered with the officer who arrested Sahouri.

The commission said in failing to initially add a disclosure statement to those signs, William Guerrette violated state campaign laws. In a separate action, it voted to assess no penalty against Guerrette. The complaint said the four electronic signs urging people to vote for Guerrette failed to include a disclaimer explaining who paid for the signs and who authorized them. Initially, Guerrette was told the signs were fine, but when his campaign was directed to add disclosure statements, the statements were added.

Sullivan citied the “recent events in our nation’s capital” and that officials or their staffs could reasonably be concerned about their safety at the statehouse or elsewhere.

It is the latest blow for Cuomo, who has been besieged by scandals involving his handling of nursing home deaths and accusations he sexually harassed two former aides and a woman he met at a wedding he officiated.

The settlement noted Kasirer assisted in raising money for the since defunct Campaign for One New York after the mayor personally asked her for assistance in raising funds for the group. The Lobbying Act prohibits lobbyists and their clients from giving gifts to a public official, which includes gifts to third parties on behalf of or at the behest of a public official. JCOPE investigated whether donations by individuals with business before the city were a gift to the mayor.

In legal disclosures, the utility said the payment to a consulting firm tied to that person led to “conduct corresponding to such payment,” and to that person “acting at the request or for the benefit of FirstEnergy as a consequence of receiving such payment.” The company said the payment led it to update its terms with its lenders on November 17. The day before, the FBI raided then-Public Utilities Commission Chairperson Sam Randazzo’s home. Randazzo quit on the day after FirstEnergy disclosed the payment.

Twitter’s court filings include a request for a temporary restraining order that would keep Paxton and his office from enforcing a demand that seeks documents revealing the company’s internal decision-making processes for banning users, among other things. Paxton, a fervent supporter of former President Trump, sent the company a civil investigative demand after it banned Trump from its platform following January’s siege at the U.S. Capitol.

West Virginia – Ethics Commission Breaks Up County Prosecutor’s Hiring of Her Boyfriend

A county prosecutor violated the law by hiring her boyfriend as an assistant prosecutor, and must terminate his employment within 30 days, the West Virginia Ethics commission ruled. A key point in the decision was the prosecutor had failed to advertise the job opening but had reached out to local lawyers about the vacancy. The commission also concluded that an organization that lobbies the Legislature may recognize a lawmaker by making a charitable contribution in the legislator’s name to a local homeless shelter in excess of the $25 limit on gifts in the Ethics Act.

The British Columbia Office of the Registrar of Lobbyists released new guidance documents this month outlining key considerations for lobbyists when declaring government funding in the Lobbyists Registry and guidance on the term “provincial entity” as it is used in the Lobbyists Transparency Act (LTA).

The LTA requires lobbyists provide information in their Registration Return about government funding, whether received or requested by their organization or client, from any government, government agency, or provincial entity in the preceding 12-month period. This is not limited to funding related to lobbying in British Columbia. Government funding includes those of any level of government, including foreign, federal, provincial, or municipal governmental entities. Non-refundable funding given in response to the COVID-19 pandemic is reportable. Now that the online Registry has been updated to permit lobbyists to declare funding, the guidance provides instructions on how to enter, remove and modify the information on a lobbyist’s report.

Similar government funding disclosure obligations are also required by federal lobbyists and lobbyists in Alberta.

The document providing guidance on the term “provincial entity” is intended to help lobbyists understand which persons working for a provincial entity are covered individuals for purposes of disclosure in lobbying reports. “Provincial entity” is specifically defined by regulation and generally refers to provincial government bodies or corporations outside core government. Provincial entities include crown corporations, school districts, public sector post-secondary institutions, such as colleges and universities, and health authorities.
