Utah Gov. Gary Herbert will likely call a special session in mid-November to remedy a flawed road funding formula based on a statewide gas price increase.
The faulty gas tax bill was passed earlier this year in the Legislature’s general session to correct a mistake in the 2015 transportation funding reform. The 2016 bill was based on differing calculations resulting in a funding deficit for some cities and counties in the state.
No other items are expected to be added to the special session agenda.
In Utah, special sessions typically take place on the monthly interim study days with November 16 being the only such day remaining this year.

On October 19, 2016, two bills were introduced to the Michigan Legislature regarding campaign finance and ethics regulation.
House Bill 6007 prohibits, for 18 months after leaving office, a former member of the Michigan Legislature from making expenditures or receiving compensation or reimbursement for actual expenses for lobbying that equal or exceed the limit established to require registration as a lobbyist agent.
House Bill 5959 prohibits campaign contributions except during a year there is a primary, general, or special election for the office the candidate is seeking to be elected.
The Legislature has 11 scheduled days to approve bills for the 2016 legislative session.

Lawmakers approved a bill allocating funding for an NFL stadium and the expansion of a convention center in Las Vegas as well as a bill to fund the hiring of more than 300 police officers.
Gov. Brian Sandoval is expected to sign the bills Monday, October 17.

State Democrats called for a special session of the General Assembly following Hurricane Matthew’s devastating impact on the state. Twenty people were killed, thousands retreated to emergency shelters, and the storm transformed one-third of the state’s 100 counties into federal disaster areas.
Senate Minority Leader Dan Blue and House Rep. Billy Richardson urged legislators to address the emergency so that funds from the state’s rainy day reserves could be distributed. Republicans denied the request. House Speaker Tim Moore and Senator Phil Berger stated it would be better to wait until the waters recede to determine long-term needs.
The General Assembly is scheduled to reconvene when the regular session starts in February.

Before it begins, Kansas lawmakers are planning for an extended regular legislative session in 2017. Usually set at 90 days, additional money has been earmarked for a 100-day session.
Continuing school finance issues and an expected revenue shortfall have been cited as reasons for the planned extension. While many lawmakers thought it was prudent to plan now rather than find the money later, others felt it sets a bad precedent going into a session not expecting to complete the Legislature’s work on time.
The session in 2018 will be budgeted at 80 days to compensate.

The special session adjourned sine die on October 6, 2016. Lawmakers approved a budget fix, and the controversial death penalty bill failed to pass the Senate. Per New Mexico law, the fundraising ban concludes at the time of adjournment.

Gov. Brian Sandoval plans to call a special legislative session in early October to approve an estimated $1.9 billion stadium funding plan. The Southern Nevada Tourism Committee is working with the Oakland Raiders and a group of private developers to bring the first professional football team and major events arena to Las Vegas. In addition, vacancies needing to be filled in the Legislature make a special session likely.
Legislators have expressed concern about holding a special session so close to the November 8 general election in part because lawmakers are prohibited from receiving campaign contributions during a legislative session and for 15 days after adjournment.
Gov. Sandoval will decide whether to call the session once he reviews the committee’s recommendations and all questions have been answered. If called, the special legislative session would be the 30th in Nevada’s 152-year history.

On August 30, 2016, Gov. Asa Hutchinson announced state Rep. Bill Gossage as his deputy chief of staff for external operations. As a result, Gossage is resigning as the House District 82 representative.
Hutchinson will not call a special election to fill the remainder of Gossage’s term because the vacancy will be filled within 150 days, as required by law. The state Republican party will be responsible for selecting a nominee to run in Gossage’s place.
Gossage was running unopposed in the November 8 general election, and other political parties will be unable to run a candidate in this race as the filing deadline has already passed.

Before adjourning, the Legislature sent several ethics bills to Gov. Jerry Brown, including Senate Bill 215, which contains provisions requiring those seeking to influence actions taken by the Public Utilities Commission to register as a lobbyists.
Brown has until September 30 to sign or veto legislation.

House Speaker Greg Stumbo has called an impromptu meeting of the House of Representatives to discuss the struggling Kentucky Retirement System and Kentucky Teachers Retirement System. Stumbo cited poor returns and high placement fees for investment managers in an email sent to all members of the House.
All members of the House are invited to the Tuesday morning meeting, but Republicans are expected to boycott. Minority Leader Jeff Hoover criticized the timing of the meeting, as it coincides with a Democratic fundraiser taking place in Frankfort.
Hoover was also puzzled by Stumbo’s sudden interest in the topic, arguing the Democrats care now only because it will be an issue in the upcoming elections.

Missouri Sen. Bob Dixon wants Gov. Jay Nixon to call a special session to close a loophole in the state’s drunk driving law and to ask the Legislature to support a pilot program for the Missouri Public Defender System.
If the drunk driving loophole is not addressed, thousands of drunk drivers could be released on a technicality or given a lesser charge because of a mistake in the law regarding how breathalyzer equipment is calibrated.
Dixon is asking for the special session to occur next to the Legislature’s veto session. The veto session begins September 14.
Gov. Nixon has not yet commented on whether he will call a special session.

On August 22, Government House Leader Yasir Naqvi released proposed amendments to a campaign finance reform bill the Ontario Legislative Assembly has been considering this session. The Election Finances Statute Law Amendment Act, 2016, Bill 201, was introduced on May 17.
Changes in the newly proposed amendments include lower contribution limits. However, the amendments do not address the “cash-for-access system” that allows those making large political contribution to have personal and interactive contact, such as dinners, with public officials, according to The Globe and Mail. The bill has been considered since June by the Standing Committee on General Government. This and other amendments are expected to be debated in the coming weeks.
