On September 30, California Gov. Jerry Brown signed a bill requiring lobbyists to complete training on sexual harassment in connection with lobbying activities.
Assembly Bill 2055 adds a component to training already required for lobbyists registered with the state and conducted by the ethics committees in both houses of the California Legislature.
The lobbyist training course now must include “information on each house of the Legislature’s policies against harassment, including sexual harassment, in connection with lobbying activities.”

On September 26, California Gov. Jerry Brown signed a bill concerning political advertising in social media. Assembly Bill 2188, the “Social Media DISCLOSE Act”, requires disclosure for advertisements made “via a form of electronic media that allows users to engage in discourse and post content, or any other type of social media”, and is paid for by a political party or a candidate-controlled committee.
The disclosure obligations fall on both the registered political parties and committees and on the “online platforms.” The online platform must maintain and make available for online public inspection a digital copy of a political advertisement, the number of impressions generated from the ad, information regarding the total amount spent on the advertisements, and other relevant information.
The bill defines an online platform as a “public-facing Internet Web site, web application, or digital application, including a social network, ad network, or search engine, that sells advertisements directly to advertisers. A public-facing Internet Web site, web application, or digital application is not an online platform for purposes of this [Act] to the extent that it displays advertisements that are sold directly to advertisers through another online platform.” The online platforms will be required to include with each political advertisement a disclosure of who funded the ad or a hyperlink to a website containing the required disclosures.
The bill takes effect on January 1, 2020.

Assembly Bill 2188, the “Social Media DISCLOSE Act”, requires disclosure for advertisements made “via a form of electronic media that allows users to engage in discourse and post content, or any other type of social media”, and is paid for by a political party or a candidate-controlled committee. Alice Germond was appointed chairwoman of the California Fair Political Practices Commission last month.
Germond and the commissioners are working to boost voter trust in the commission “so that they have faith when they go to the election booth that their vote is not bought and that the playing field is level and that the basic part of democracy is working for them.”
Germond will be the chair until January, when the newly-elected governor will have the option to appoint a new chairperson.

Under special-election rules, if no candidate gets an outright majority of votes on April 3, a runoff between the top two vote-getters will be held June 5.
Matt Dababneh, who represented District 45, resigned his seat after being accused of sexual misconduct by multiple women.
Sebastian Ridley-Thomas, who represented District 54, resigned because of health problems.

Gov. Jerry Brown signed Assembly Bill 867 into law, recasting various provisions of the Political Reform Act regarding the definition of the term contribution.
The law moves the behested payment reporting requirements out of the definition of contribution, and instead places those requirements in the part of the campaign disclosure sections of the act.
Additionally, the law provides specific definitions for terms related to behested payments and the reporting of such payments. The law is effective January 1, 2018.

Assembly Bill 867 states behested payments are not contributions and recasts the provisions defining the term “contribution.”
Senate Bill 45 prohibits sending mass mailings within the 60 days before an election by or on behalf of a candidate on the ballot.
Senate Bill 226 requires slate mailer organizations to disclose on any mailing whether the organization represents public safety personnel.
Assembly Bill 1620 extends the time frame a member of the Legislature can lobby after resignation from one year after leaving office to one year after the adjournment sine die of the session in which the resignation occurred.

On Tuesday, Gov. Jerry Brown signed Senate Bill 267 and Senate Bill 358 into law.
Senate Bill 267 authorizes the Fair Political Practices Commission to have primary responsibility for the impartial, administration, implementation, and enforcement of a local campaign finance reform of the city of Sacramento, effective immediately.
Senate Bill 358 requires the secretary of state’s website to post hyperlinks to the website of any local government agency containing publicly disclosed campaign finance information.

Gov. Jerry Brown signed Assembly Bill 249 on October 7, which amends the Political Reform Act.
The bill requires campaign advertisements to identify the name of the committee paying for the advertisement, as well as clearly displaying the top three contributors to that committee.
The bill also expands disclosure requirements for mass electronic mailings and telephone calls. The bill is effective immediately.
