This month, the Texas Ethics Commission adopted a new rule adjusting the compensation and reimbursement threshold for lobbyists.

The new rule eliminates an exception not requiring a person to register as a lobbyist if he or she lobbied no more than five percent of his or her compensated time during a calendar quarter. Under the new rule exception, a person is not required to register as a lobbyist if the person spends not more than 40 hours during a calendar quarter engaging in lobbying activity for which the person is compensated or reimbursed.Time spent on preparatory activity is included in determining whether the 40-hour threshold has been met.

This rule goes into effect January 1, 2017.

On December 16, the Commissioner of Political Practices’ proposed rule amendment increasing the threshold amount of payment triggering lobbyist and employer registration to $2,550 for 2017 and 2018 was adopted.

The payment threshold is adjusted by an inflation factor determined by the commissioner. The previous threshold amount was $2,500 for the calendar years 2015 and 2016.

The Georgia Government Transparency and Campaign Finance Commission has announced the lobbyist registration renewal window for 2017.

Current lobbyists who do not owe any fees, fines, penalties, or reports may renew their registrations online beginning December 1, 2016, until 12:00 p.m. on January 13, 2017. Lobbyists who fail to timely renew their registration must register as a new lobbyist using paper forms.

Lobbyist badges are also expected to be sent much sooner than in past years. The Commission has asked lobbyists to allow up to two weeks for badges to be delivered.

On October 12, the City Council adopted a new lobbying law for the city of Reno, Nevada.

The Registration and Regulation of Lobbyists ordinance requires lobbyists to register with the city clerk, to inform the city of their clients, and to wear lobbyist badges when in City Hall. The ordinance also includes civil and criminal penalties.

The new law will take effect on January 1, 2017.

On August 31, the California Legislature adjourned its regular session.

Before adjourning, the Legislature sent several ethics bills to Gov. Jerry Brown, including Senate Bill 215, which contains provisions requiring those seeking to influence actions taken by the Public Utilities Commission to register as a lobbyists.

Brown has until September 30 to sign or veto legislation.

Santa Monica City Council passed new rules on August 9 for implementation of the city’s lobbyist regulation ordinance.

The rules set out lobbyist registration requirements and registration fees. The ordinance will go into effect September 19, 2016 with an initial lobbyist registration period from September 19 through October 31, 2016.

On August 10, the Reno, Nevada City Council and the City Charter Committee met to discuss a possible new lobbying law.

The City Charter Committee recommended adding a new lobbying law to the city charter unless the City Council passes a lobbying law through an ordinance before this fall’s November general election. While the City Council considered adopting an ordinance earlier this year, the Charter Committee “feels that the remaining three months until the general election is ample time for Council to formally approve a lobbyist registration system,” according to the Charter Committee’s Final Report and Recommendations presented at the meeting.

Also addressed at the meeting were the filing frequency of campaign finance reports by candidates for public office; ward-only voting for primary, general, and special elections; and other city issues.

The City Council of Côte Saint-Luc passed a formal resolution stating opposition to proposed changes to Quebec’s Lobbying Transparency and Ethics Act.

The council opposes the measure that would require nonprofit groups to register as lobbyists. The resolution is being sent to the Quebec Lobbyists Commissioner and the Minister of Quebec Intergovernmental Affairs.

The Oregon Government Ethics Commission has asked Gov. Kate Brown to introduce legislation in 2017 to strengthen lobbying registration requirements. The commission wants to crack down on the registration exception that allows persons spending less than 24 hours or $100 on lobbying per quarter to avoid registering as lobbyists.

Brown has until December 9, 2016 to review proposals from state agencies and file bills for the 2017 session.

On May 25, the Reno City Council will consider requiring lobbyist to register with the city. At tomorrow’s council meeting, an ordinance is being introduced entitled “Registration and Regulation of Lobbyists.”

The ordinance would require lobbyists to register with the city clerk, to inform the city of their clients, and to wear a lobbyist badge when in city hall. The ordinance also includes civil and criminal penalties.

The City Council heard two proposed ethics reforms at yesterday’s council meeting. An ordinance introduced to require political consultants working with Portland politicians to meet certain reporting and registration requirements was passed by the council and will go to a second reading at next week’s meeting following some minor amendments.

The other ordinance introduced to broaden revolving door prohibitions and close a loophole in registration requirements was not viewed as favorably by the council. The council will reconsider this ordinance at the May 11, 2016 council meeting.

Just days after Gov. Matt Bevin vetoed a bill to raise the executive agency lobbyist registration fee, proponents of the increase will have another bite at the apple. Lawmakers came to an agreement on the state budget in the earlier hours of Thursday morning and included a provision allowing the Executive Branch Ethics Commission to increase the fee, currently set at $125. The bill does not provide an amount for the increase.

The budget will be voted on tomorrow, April 15, the final day of the legislative session. Gov. Bevin will then have the final say as lawmakers will not have the opportunity to override any line-item vetoes.

Gov. Matt Bevin has vetoed a bill to increase the executive branch lobbyist registration fee. House Bill 423, a state revenue bill, would have increased the fee from $125 to $275.

Katie Gabhart, executive director of the Executive Branch Ethics Commission, said the increase was necessary to avoid cutting its staff. The agency now faces a $40,000 budget deficit and, after lean years during the previous administration, Gabhart said there is nothing left to cut besides salaries.
