A statewide special election will be held June 5, the same date as the primary elections, on a proposed amendment to the South Dakota Constitution.

If approved, the amendment will affect Marsy’s Law victim’s rights provisions approved by voters in 2016.

The attorney general’s deadline to prepare a statement, title, explanation, and recitation of a “Yes” or “No” vote for the proposed amendment is March 27.

South Dakota Gov. Dennis Daugaard signed a bill into law expanding campaign finance disclosure requirements.

House Bill 1003 requires candidates and committees to itemize any contribution received from an entity.

An entity includes corporations, labor unions, and non-profits, as well as other associations not a natural person or political committee.

On December 29, South Dakota Secretary of State Shantel Krebs certified the South Dakota Voter Protection and Anti-Corruption Amendment as Constitutional Amendment W for the November 2018 ballot.

If passed, Constitutional Amendment W would create an independent ethics commission, would decrease limits on campaign donations, would bar gifts from lobbyists to many public officials, and would prevent the Legislature from altering or rejecting laws approved by ballot question without returning to the ballot.

More than 51 percent of voters supported a similar initiative in November 2016, but lawmakers repealed it in early 2017, citing constitutional concerns.

The group Represent South Dakota met the November 6 deadline for submitting petition signatures to the Office of the Secretary of State to add a constitutional amendment to the 2018 ballot.

The amendment would tighten campaign finance and lobbying restrictions, create an independent ethics commission, and require laws changing the ballot question process to pass a public vote.

House speaker Mark Mickelson also met the deadline to turn in petition signatures for an initiative that would ban out-of-state political contributions for ballot questions, affecting groups such as Represent South Dakota.

On June 27, Rep. Don Haggar, a Republican lawmaker from Sioux Falls, resigned effective immediately from his District 10 position to become the director for the state’s chapter of Americans For Prosperity.

Americans for Prosperity is the conservative advocacy group founded by the Koch brothers.

Haggar’s resignation comes days before a new state law takes effect that would require Haggar to wait two years before becoming a lobbyist. The current wait time is one year.

The vacancy will be filled by gubernatorial appointment.

Gov. Dennis Daugaard called a special session for June 12 to consider legislation relating to public recreational use of non-meandered waters overlying private property.

The issue comes after a Supreme Court opinion prohibited state officials from facilitating access to waters on private property.

Under the drafted legislation to be considered by lawmakers during the special session, South Dakota’s Game, Fish and Parks Department would be able to negotiate with landowners to open access to such lakes for recreation.

The group Represent South Dakota announced plans to lead efforts for a ballot measure in 2018 to amend South Dakota’s constitution to tighten ethics laws.

The Voter Protection and Anti-Corruption Amendment would ban lobbyist gifts to politicians, lower campaign contribution limits, and restrict the ability of lawmakers to overturn laws passed by voters.

Represent South Dakota has already filed the proposal with the Legislative Research Council and expects to start collecting signatures in June 2017.

The push for the new constitutional amendment comes in response to the recent repeal of Initiated Measure 22. Initiated Measure 22 was the voter approved ethics and campaign finance overhaul that established various lobbying and campaign finance restrictions.

On March 27, South Dakota lawmakers met for the final day of the 2017 legislative session to consider five bills Gov. Dennis Daugaard vetoed.

Two-thirds support is required to overturn a gubernatorial veto and lawmakers failed to raise enough support to override any of the vetoes up for consideration.

The next legislative session is set to convene January 9, 2018.

On March 14, Gov. Dennis Daugaard signed Senate Bill 54 into law. The bill revises many requirements dealing with campaign finance to strengthen campaign finance laws after the repeal of Initiated Measure 22.

Senate Bill 54 will allow organizations, such as corporations and labor unions, to contribute directly to candidates. The measure also restricts candidates from using campaign funds for personal expense.

Senate Bill 54 was initially introduced with provisions to lower contribution limits; however, those provisions were amended prior to the bill’s passage to reflect pre-Initiated Measure 22 limits.

On March 10, Gov. Dennis Daugaard signed a series of bills aimed at replacing ethics and campaign finance laws after the repeal of Initiated Measure 22.

Among the bills signed into law, Senate Bill 131 prohibits elected officers and officials from lobbying in the two-year period after termination of service in the state government.

House Bill 1073 was approved to set a $100 annual cap on gifts from lobbyists to elected officials. House Bill 1073 also defines “gift” to exclude food, beverages, and entertainment.

The Governor also signed House Bill 1076, establishing a government accountability board.

The Governor is expected to approve other pending Initiated Measure 22 replacement bills. The pending bills currently on the Governor’s desk include Senate Bill 54 to revise campaign finance limits and disclosure requirements and Senate Bill 171 to establish a government accountability task force to study campaign finance.

The South Dakota House of Representatives passed an amended version of Senate Bill 54 restoring campaign finance limits to pre-Initiated Measure 22 levels.

Senate Bill 54 was originally introduced to establish tougher campaign finance restrictions to preserve the spirit of Initiated Measure 22 after lawmakers repealed the voter approved measure earlier this session.

Prior to passing the House with a vote of 55 to 12, the bill was amended many times before arriving at its current state. Senate Bill 54 now goes back to the Senate for approval of the amended version.

On February 28, the House of Representatives passed Senate Bill 131 to ban elected officers and other officials from lobbying during a period of two years after termination of service in the state government. The bill now goes to Gov. Dennis Daugaard for consideration.

Senate Bill 131 is one of the pieces of legislation that was introduced by lawmakers to placate citizen outrage after lawmakers repealed Initiated Measure 22, the voter approved measure to overhaul ethics and campaign finance laws.

Thursday, February 23, is South Dakota’s crossover day, which is the final day for lawmakers to pass bills out of their chamber of origin.

Ahead of the deadline, lawmakers are set to consider campaign finance and ethics bills that were proposed in the wake of the repeal of Initiated Measure 22.

A bill to create a state government accountability board is scheduled to be heard by the House on Wednesday, February 22, and another bill to increase the revolving door restriction to three years was scheduled to be heard by the House on Tuesday, February 21.
