Here is my personal favorite today: They have taken a poll in New Jersey and found that people there are tired of the cursing and name calling among their politicians. Louisiana Governor Bobby Jindal has made legislative proposals to enhance the state’s ethic rules.

In advance of the start of the legislative session next month, the Governor has staked out the areas of Louisiana’s ethic system he believes need the most attention, including making the process of appealing late filing fees unambiguous.

Among his other proposals are making a clearer distinction between the duties and jurisdictions of the Ethics Adjudicatory Board and the Board of Ethics, granting the Board of Ethics some ability to appeal Ethics Adjudicatory Board decisions, and clearly articulating which board is being referenced when a statute merely refers to a ‘board’.

The proposals, included in a press release from the Governor, also include a call for the Ethics Board to suspend the one year dismissal rule in certain circumstances during an investigation of a possible ethics violation.

The article says, “[House Clerk Alfred] Speer said the House’s agenda will include mock committee meeting and floor sessions, as well as discussions of ethics laws, parliamentary procedure, introduction to legislative staff, key dates for filing bills, and one called ‘Norms of Behavior or How to Operate within the House and Keep Your Integrity and Sanity.'”

Louisiana Governor Bobby Jindal signed House Bill 509 into law, changing the date of the state’s presidential primary. The primary moves to March on the first Saturday which follows the first Tuesday. Previously, the presidential primaries were held in February.

The change in law becomes effective immediately.

The 2011 regular session of the Louisiana Legislature adjourned sine die on June 23, 2011.

Upon transmittal of a bill, Governor Bobby Jindal will have 20 days to sign or veto the legislation.

A Louisiana House bill now in the Senate would reduce some public contracts by ten-percent for fiscal year 2011-2012.

As originally introduced, House Bill 15 would require a ten-percent reduction in the total dollar amount for professional, personal, and consulting service contracts. House and Senate amendments, both concerned about the bill negatively affecting some social services, delete references to professional and personal services, limiting the focus to consulting services.

Under the bill, new contracts with the state could not exceed the reduced dollar amount determined by existing contracts. Examinations of these contracts would fall under the jurisdiction of the Office of Contractual Review.

A special legislative session has been announced for March 30, 2011 to redraw state and federal districts. The redistricting will include congressional, state education board, and judicial districts.

Significant district changes are anticipated due to overall population decline and shifts in population concentration as a result of Hurricane Katrina. The session has been called by legislators, not the governor, for the first time in state history.

Although the provisions of the bill were enacted as a new and separate chapter in the Louisiana Revised Statutes, they largely mirror the requirements of the lobbying laws already applicable to legislative and executive branch lobbying on the state level.  For example, as it is on the state level, registrations expire on December 31^st of each year and registration renewals are due on January 31^st at the latest.  Reports of local lobbying activity are due on the 25^th day of each month, as they are at the state level.  And the information required to be disclosed is largely the same.

The bill contains a provision found in the state executive branch lobbying law, but not in the legislative branch lobbying law, which allows an employer to file reports on behalf of all the lobbyists representing that employer’s interests.  An employer wishing to exercise that option must notify the board of ethics by January 31^st.

Unlike the state-level lobbying laws, the bill does not specify a registration fee for local lobbyists.

The Louisiana Board of Ethics is responsible under the bill for administering and enforcing the provisions of the bill.  This includes educational activities and seminars related to the bill, as well as the assessment of late filing fees.

State and Federal Communications will continue to monitor developments with regard to local lobbying laws in Louisiana as the bill goes into effect and is implemented by the board of ethics.

The 19th Judicial District Court of Baton Rouge has ruled the Ethics Board cannot enforce penalties for campaign finance violations. The court found a separate Ethics Adjudicatory Board must conduct public hearings when the Ethics Board alleges the late filing of, or absence of filing, campaign reports.

The Ethics Board had argued campaign violations requiring investigations were already referred to the Ethics Adjudicatory Board, but cases involving the mere failure to file reports on time, or not at all, did not require any investigation, and therefore did not require a separate hearing. The division of giving the Ethics Board investigatory and prosecutorial authority, while giving the Ethics Adjudicatory Board judicial power, comes from a 2008 change in the law meant to streamline the regulatory process.

Louisiana Gov. Bobby Jindal has signed House Bill 292, a measure which will switch the state’s congressional elections to an open primary system, effective for the 2012 congressional elections.

Instead of the currently utilized three-tiered election cycle, wherein there is a party primary, followed by a party runoff, and culminating with the general election, HB 292 now advances the candidates with the top two vote totals from the primary to the November general election, regardless of party affiliation.

Jindal was under pressure from both political parties to not sign the bill into law, but he noted that the measure will potentially save the state more than $13 million during each congressional election cycle.
