Minnesota Governor Calls Legislature to Special Session
Session to Address Budget Agreement
Minnesota Governor Mark Dayton has called a special legislative session to begin today at 3 p.m. for a vote on a budget agreement that would end the state’s government shutdown.
Governor Dayton stated that some state agencies could re-open as early as Wednesday if the budget agreement is finalized.

Judge Halts Enforcement of Washington Recall Campaign Contribution Limits
Constitutionality to Be Determined at Trial
U.S. District Court Judge Robert Bryan has issued a preliminary injunction barring the state from enforcing campaign contribution limits with respect to an effort to recall the Pierce County assessor. Washington restricts contributions to recall campaigns to $800 or less, though political parties and their official committees may contribute more.
In his decision Judge Bryan stated “the public interest in upholding free speech and association rights outweighs the interest in continued enforcement of these campaign finance provisions.”
Enforcement of the recall campaign contribution limits is enjoined pending a trial over whether the limits are constitutional.

Green Bay City Council Passes Lobbyist Registration Ordinance
Ordinance Effective Immediately
GREEN BAY, WISCONSIN: The Green Bay City Council has approved General Ordinance No. 10-11, which requires lobbyists to register if they attempt to influence legislative or administrative action by a city official.
The ordinance requires lobbyists to register before engaging in lobbying by completing a registration form and paying a $20 registration fee.
Lobbyists must disclose their contact information, the name of their client, and any compensation paid by the client.
The ordinance is effective immediately and the City Clerk’s Office will be making a lobbyist registration form available in the next month.

Enforcement of Philadelphia Lobbying Law Delayed
Law Facing Challenges from Philadelphia Bar Association
The Philadelphia Board of Ethics has announced it will delay enforcement of the city’s lobbying law until 30 days after the effective date of proposed board regulations.
According to a board resolution, the earliest that enforcement of the lobbying law may begin is September 26, 2011. P.C.C. §20-1200, which created Philadelphia’s lobbying law, became effective July 1. The board has previously announced that lobbyist registration will not begin until July 18, 2011 because of delays in implementing the electronic registration system.
Additionally, the Philadelphia Bar Association has filed suit challenging Philadelphia’s new lobbying law as being too far reaching. The Bar Association contends that the law’s definition of the term “lobbyist” unfairly targets lawyers who are not engaged in lobbying activities, and that only the state Supreme Court can regulate lawyers.

U.S. Supreme Court Strikes Down Arizona Clean Elections System
In a 5-4 decision, the U.S. Supreme Court struck down an Arizona campaign finance law that offered extra public funding to state political candidates who faced increased opposition spending.
The Citizens Clean Elections Act, passed by voters in a 1998 ballot initiative, gave candidates extra money if they face well funded opponents that opted out of the state election financing system.
Candidates also could qualify for greater public financing based on political spending by independent political groups that ran advertisements opposing their candidacy or supporting other candidates.
Chief Justice John Roberts wrote “laws like Arizona’s matching funds provision that inhibit robust and wide-open political debate without sufficient justification cannot stand.”

Regular session ended on June 24.
Legislators concluded the 2011 regular session Friday evening after reaching agreement on a number of bills.
Governor Andrew Cuomo has 10 days upon transmittal of a bill to sign or veto legislation that reaches his desk.

Ethics Reform Bills to Be Introduced
Bills Address Campaign Finance Reporting and Official Vehicle Use
District of Columbia Councilman Tommy Wells has announced that he will introduce three ethics reform bills to address recent ethical issues raised in the district council.
The Campaign Finance Accountability and Reform Amendment Act of 2011 establishes reporting requirements to the Office of Campaign Finance for contributions and expenditures related to transitions and inaugurations and prohibits the bundling of corporate contributions.
The Campaign Finance Reporting Amendment Act of 2011 alters the financial disclosure reporting schedule to coincide with the new primary election date of the first Tuesday of April in an election year.
The Government Vehicles and Fleet Management Rationalization Amendment Act of 2011 prohibits the procurement of “luxury-class” vehicles and freezes the current fleet size.

Delaware Governor Unveils New Procurement Website
Website Seeks Simplify Procurement Process
As part of the Governor’s Entrepreneurial Business Conference, Governor Jack Markell unveiled a new website to expedite the process of doing business with the state.
The new website http://mymarketplace.delaware.gov, serves as a single information source for the entire procurement process.
The website was developed by Delaware’s Office of Management and Budget to combine information from different sources regarding vendor registration, bidding procedure, and bid solicitation.

Special Session to Convene Friday
Governor Jan Brewer has called the Legislature to begin a special session on Friday, June 9, 2011.
The purpose of the special session is to extend unemployment benefits for the state’s jobless.

Ethics Bill Formerly Known as the Clean Up Albany Act Released
Bill Creates Joint Commission on Public Ethics and New Disclosure Requirements
The New York Governor’s Office has released the ethics bill created by the agreement between legislators announced last Friday. The bill, which had previously been titled the Clean Up Albany Act of 2011, will be known as the Public Integrity Reform Act.
Chiefly, the bill establishes an independent Joint Commission on Public Ethics and enhances disclosure requirements by requiring state employees to disclose income from outside sources and names of clients. The Joint Commission on Public Ethics will have jurisdiction over all elected state officials and their employees in the executive and legislative branches, as well as lobbyists.
The bill provides the Joint Commission on Public Integrity must create an online ethics training course for registered lobbyists with a specific curriculum regarding the public officers’ law and ethics to be completed every three years. Additionally, the bill requires the disclosure by lobbyists of any reportable business relationship of more than $1,000 with public officials.
The definition of “widely attended” event is altered to include any event where 25 or more people other than legislators, officials, or government employees attend and which is related to the attendee’s duties or which allows the public official to perform a ceremonial function. The bill also allows officials to accept food or beverage valued at $15 or less.
The bill increases penalties for violations of the filing requirements and contribution limits and provides for a special enforcement proceeding in the Supreme Court.
The bill must age three days after its introduction and then can be voted on by the Legislature. The Legislature will recess today until next Monday, making adoption possible next week.

Tennessee Bill Allowing Corporate Contributions Becomes Law
Contribution Limits Increased
Tennessee Governor Bill Haslam has signed Senate Bill 1915 (companion to House Bill 1003) into law.
The bill allows corporations to contribute to candidates by removing the previous statutory prohibition. The bill also adjusts contribution limits to reflect change in the Consumer Price Index.
The new law is effective immediately.

Special Election Scheduled for August 9, 2011 to Fill Vacant Assembly Seat
Primary Set for July 12, 2011
A special election has been scheduled for August 9, 2011 to fill a seat left vacant in Assembly District 48.
In an executive order, Governor Scott Walker ordered the special election to fill the seat left vacant after the resignation of Joe Parisi, who was elected Dane County Executive in April.
If a primary is necessary in the district, it will be held on Tuesday, July 12, 2011.

Governor Appoints New Commissioner of Political Practices
The appointment requires Senate confirmation.
Governor Brian Schweitzer has appointed Dave Gallik to serve as Montana’s Commissioner of Political Practices.
Gallik previously worked as Staff Attorney for the Montana State Insurance Commissioner and served for several years in the Montana House of Representatives.
The Commissioner of Political Practices is appointed to serve one six-year term and requires Senate confirmation.

Governor Martinez Signs Executive Orders to Improve Procurement Process
Orders Aim to Make Procurement More Ethical and Efficient
New Mexico Governor Susana Martinez has signed two executive orders that seek to improve the procurement process in New Mexico.
Executive Order 2011-030 authorizes the suspension or debarment of businesses for conviction of fraud, embezzlement, theft, forgery, bribery, falsification, destruction of records, receiving stolen property, antitrust violations, willful failure to perform in accordance with contracts, and any other cause occurring within the preceding three years of a procurement which the state purchasing agent or a central purchasing office determines to be so serious and compelling as to affect responsibility as a contractor.
Executive Order 2011-031 created the Governor’s Task Force on Procurement Reform to review and update the current statutory and regulatory Procurement Code and to increase transparency and efficiency in the procurement process.
